When will employees be entitled to have Tet holiday in Vietnam in 2024?

On November 22, the Ministry of Labor, War Invalids and War issued Announcement 5015/TB-LDTBXH 2023 on Lunar New Year in 2024 of officials, public employees and employees.

Accordingly, the 2024 Tet holiday schedule for officials, public employees and employees working at administrative agencies, political organizations or socio-political organizations (hereinafter referred to as “officials and public employees”) is as follows:

- Officials, public employees and employees working at administrative agencies, political organizations or socio-political organizations (hereinafter referred to as “officials and public employees”) are entitled to have the Lunar New Year holiday in 2024 from Thursday, February 08, 2024 of the solar calendar (i.e. December 29, 2023 of the lunar calendar) to the end of Wednesday, February 14, 2024 of the solar calendar (i.e. January 05, 2024 of the lunar calendar). This holiday includes 05 days of the Lunar New Year holiday and 02 days of compensatory time-off for the weekly days off as prescribed in Clause 3 Article 111 of the Labor Code.

Thus, officials, public employees and employees are entitled to have the Lunar New Year holiday in 2024 from Thursday, February 08, 2024 of the solar calendar.

For employees in enterprises, the Ministry of Labor, War Invalids and Social Affairs said that employers may adopt the following holiday schedule for Lunar New Year and National Day in 2024. The schedule for employees is as follows (Employers are encouraged to adopt the same Lunar New Year holiday schedule for their employees as officials and public employees).

- Lunar New Year holidays in 2024:

+ The Lunar New Year holiday may include 01 ending day of the year 2023 and 04 beginning days of the year 2024 of the lunar calendar, or 02 ending days of the year 2023 and 03 beginning days of the year 2024 of the lunar calendar, or 03 ending days of the year 2023 and 02 beginning days of the year 2024 of the lunar calendar.

+ The schedule shall be notified to employees at least 30 days before implementation

Lunar New Year 2024 falls on Saturday and Sunday of the week, so the number of days off for Lunar New Year 2024 for employees will be as follows:

*In cases where employees do not have to work on Saturday of the week

- For employers adopting 01 ending day of the year 2023 and 04 beginning days of the year 2024 of the lunar calendar:

Employees are entitled to have the Lunar New Year holiday in 2024 from Friday, February 9, 2024 (December 30, of the lunar calender) until Thursday, February 15, 2024 (the 6th day of Tet).

- For employers adopting 02 ending day of the year 2023 and 03 beginning days of the year 2024 of the lunar calendar:

Employees are entitled to have the Lunar New Year holiday in 2024 from Friday, February 8, 2024 (December 29, of the lunar calender) until Thursday, February 14, 2024 (the 5th day of Tet).

- For employers adopting 03 ending day of the year 2023 and 02 beginning days of the year 2024 of the lunar calendar:

Employees are entitled to have the Lunar New Year holiday in 2024 from Friday, February 7, 2024 (December 28, of the lunar calender) until Thursday, February 13, 2024 (the 4th day of Tet).

Thus, employees will have 7 consecutive days off, including 5 days off for Lunar New Year according to State regulations and 2 days off (due to overlapping holidays on Saturday and Sunday).

*In cases where employees have to work on Saturday of the week

- For employers adopting 01 ending day of the year 2023 and 04 beginning days of the year 2024 of the lunar calendar:

Employees are entitled to have the Lunar New Year holiday in 2024 from Friday, February 9, 2024 (December 30, of the lunar calender) until Thursday, February 14, 2024 (the 5th day of Tet).

- For employers adopting 02 ending day of the year 2023 and 03 beginning days of the year 2024 of the lunar calendar:

Employees are entitled to have the Lunar New Year holiday in 2024 from Friday, February 8, 2024 (December 29, of the lunar calender) until Thursday, February 13, 2024 (the 4th day of Tet).

- For employers adopting 03 ending day of the year 2023 and 02 beginning days of the year 2024 of the lunar calendar:

Employees are entitled to have the Lunar New Year holiday in 2024 from Friday, February 7, 2024 (December 28, of the lunar calender) until Thursday, February 12, 2024 (the 3th day of Tet).

Accordingly, employees will have 6 consecutive days off, including 5 days off for Lunar New Year according to regulations and 1 day off (coinciding with the weekly Sunday holiday).

Note: The above Tet holiday schedule is for reference only. The 2024 Lunar New Year schedule will depend on each business.

Vietnam: Is it compulsory for employers to provide annual Tet bonuses to employees?

Article 104 of the 2019 Labor Code regulates bonuses for employees as follows:
