On July 3, 2023, the Ministry of Education and Training of Vietnam issued Decision 1927/QD-BGDDT in 2023 implementing Decision 1046/QD-TTg dated September 6, 2022 promulgating the Implementation Plan Conclusion 40-KL/TW dated February 21, 2022 on downsizing and restructuring the team of officials and public employees; Conclusion 40-KL/TW dated July 18, 2022 on improving the efficiency of payroll management of the political system in the period 2022 - 2026 and Regulation 70-QD/TW dated July 18, 2022 on management staffing of the political system.

Accordingly, the Plan issued together with Decision 1927/QD-BGDDT in 2023 clearly states the tasks and solutions set out according to the Downsizing plan of the Ministry of Education and Training of Vietnam as follows:

(1) Review, supplement and improve the functions, tasks, powers and working relationships of organizations, agencies and units:

+ Specific instructions on the functions, tasks, powers, organizational structure and operating regulations of the Management Council in public service units in the education sector/field, the relationship between the Council managed with the heads of public service units and superior management agencies according to the provisions of law.

+ Review and improve the functions, tasks, and working relationships of agencies, organizations, and units, ensuring there are no overlapping functions and tasks, and only one agency is responsible for implementing one task. .

(2) Complete the construction of job positions, titles and leadership positions; Manage payroll and restructure the team of officials and public employees of each organization, agency and unit according to job position

+ Guidance on the number of people working in public service units in the education and training industry/field.

What are the rules for downsizing in Vietnam?

Pursuant to the provisions of Article 3 of Decree 29/2023/ND-CP stipulates as follows:

Rules for downsizing
1. Ensure the administration of the Communist Party and the management of the State; uphold the supervisory role of socio-political organizations and citizens during the downsizing.
2. Downsizing and reorganizing the organizational apparatus should be linked to improve the efficiency and effectiveness of organizations, as well as to improve the quality of officials and public employees according to their positions, while maintaining the autonomy of organizations.
3. Commit that the downsizing is conducted democratically, objectively, openly, and transparently and in accordance with applicable laws.
4. Sufficiently and promptly settle all severance packages to displaced employees under applicable laws, effectively use the State budget.
5. The Heads of organizations shall be responsible for the downsizing within their jurisdiction.
6. If displaced employees are elected or re-recruited to organizations on State payrolls within 60 months after the date of downsizing, they must refund the severance packages they received before.

Accordingly, the rules for downsizing must comply with the above regulations.

Decree 29/2023/ND-CP officially takes effect from July 20, 2023.
