What are the procedures for inspection and issuance of registration documents for sea-going ships in Vietnam?

Pursuant to the provisions of Section 7 of the Administrative Procedures promulgated together with Decision 877/QD-BGTVT in 2023, the procedures for inspection and issuance of registration documents for seagoing sea-going ships in Vietnam shall be carried out as follows:

- The applicant shall submit 01 (one) complete application as prescribed to the Vietnam Register Branch Office (hereinafter referred to as “VRBO”) in person or by post or through an online public service portal or by another appropriate method.

- Receipt of application: VRBO shall receive the application and inspect its adequacy: if the application is inadequate, instruct the applicant to complete it within the working day (if the application is submitted in person or through an online public service portal) or within 02 (two) working days from the date of application receipt (if the application is submitted by post and another appropriate method); if the application is adequate, within 07 (seven) working days from the date of receipt, agree with the applicant about the time of inspection at the place required by the applicant.

- After the sea-going ship inspection, if the inspection result is satisfactory, issue registration documents to the sea-going ship within 02 (two) working days from the end of the initial or periodic inspection and within 01 (one) working day from the end of the annual inspection, docking inspection, intermediate inspection or occasional inspection. If the inspection result is unsatisfactory, notify the applicant in writing.

In case of an imported sea-going ship, VRBO shall issue a document certifying its technical status if the initial inspection result is satisfactory.

- The applicant shall receive the result directly at VRBO or by post or through an online public service portal or by another appropriate method.

Requirements and conditions for carrying out the administrative procedures:

A Vietnam sea-going ship issued with registration documents must comply with relevant national technical regulations on classification and construction of sea-going ships, tonnage measurement, sea-going ship safety equipment, lifting gear used on board, and sea-going ship pollution prevention systems. With regard to sea-going ships operating in international routes, their sea-going ship manuals must also comply with international treaties applicable to sea-going ships in terms of maritime safety, security, labor and prevention of environment pollution to which the Socialist Republic of Vietnam is a member.

1. Approval for sea-going ship manuals.
2. Assessment of sea-going ship designs.
3. Inspection, classification, and issuance of technical certificates in terms of maritime safety and pollution prevention for sea-going ships with respect to new construction, conversion, restoration, import, and operation.
4. Verification and issuance of safety management certificates, maritime security certificate, and maritime labor certificates for sea-going ships as specified in ISM Code, ISPS Code, and Maritime Labor Convention 2006.
5. Technical verification to serve the purchase, sale, charter of sea-going ships, investigation of marine incidents and accidents as required by regulatory agencies or sea-going ship owners, insurance buyers or sellers, sea-going ship buyers, sellers, and charterers.
6. Inspection and certification of technical safety and environment pollution prevention in terms of containers, machinery, materials, equipment used in sea-going ships with respect to manufacturing, assembly, import, restoration, and conversion.
7. Verification and certification of facilities meeting conditions for new construction, conversion, and repair of sea-going ships; verification and certification of facilities provide testing and services of safety equipment testing and manufacturers in connection with technical safety and environment pollution prevention of sea-going ships.
8. Verification and issuance of documents of compliance to companies as prescribed in ISM Code.
9. Issuance of certificates of drill for company safety management officers and company security officers, sea-going ship security officers as specified in ISM Code and ISPS Code.
10. Issuance of welder certificates as prescribed in national technical regulation on classification and construction of sea-going ships.

Thus, the contents of registration of sea-going ships in Vietnam shall comply with the above regulations.
