What are the regulations on postal activities and postal services in Vietnam?

Pursuant to Clauses 1 and 3, Article 3 of the 2010 Law on Post as follows:

Article 3. Interpretation of terms
In this Law, the terms below are construed as follows:
1. Postal activities include activities of investing and commercially dealing in, and providing and using postal services, public postal services and postage stamps.
...
3. Postal service means a service of accepting, transmitting and delivering postal articles by various modes other than electronic ones from the place of the sender to the place of the recipient through the post network.

What are the procedures for applying for a postal license in Vietnam?

Pursuant to subsection 1, Section 1, Part II of the List promulgated together with Decision 882/QD-BTTTT as follows:

- The enterprise completes the application for issuance of a postal license according to regulations and submits it to the Ministry of Information and Communications.

- Within 03 working days from the date of receiving the applications, the Ministry of Information and Communications shall refuse to grant postal licenses in case it is not within its competence and clearly state the reasons.

- Within 20 working days, the Ministry of Information and Communications shall issue a postal license if the application is completed and follows the regulations. In case the application has issues, the Ministry of Information and Communications notifies enterprises to amend and supplement.

- Within 15 working days from the date of notification, the enterprise is responsible for amending and supplementing the application as required. In case the enterprise fails to amend or supplement the application as required, or has amended and supplemented but it has not met the requirements, the Ministry of Information and Communications shall issue a notice of refusal to grant a postal license, including clea reasons.

- The notices of the Ministry of Information and Communications are made in writing and through the online public service system.

- The results of handling procedures for grant of postal licenses, written confirmations of notices of postal activities shall be paid directly or via the public postal service.

What are the regulations on the documents and quantity of the application for applying for a postal license in Vietnam?

Pursuant to subsection 1, Section 1, Part II of the List promulgated together with Decision 882/QD-BTTTT as follows:

Composition of the application:

- An application for issuing a postal license;

- A copy of business registration certificate, including Composition and quantity

- Charter of the enterprise (if any);

- Plan on Trading;

- A form of contract for the supply and use of postal services in accordance with the provisions of the law on post;

- Samples of logos, trademarks, special symbols or elements under the identification system of the enterprise shown on the postal items (if any);

- List of postal service charges in accordance with the provisions of the law on post;

- Standards on Postal service quality announced to be applied in accordance with the provisions of the law on post;

- Regulations on the limit of liability for compensation in case of damage, the process of customer complaint settlement, and the time limit for complaint settlement in accordance with the provisions of the law on post;

- Agreement with other enterprises, foreign partners in Vietnamese for cooperation in supplying one, several or all stages of the postal service to apply for a postal license;

- Documents on the legal status of the foreign partner legalized consular;

- Franchise contract with the postal service provider (if any).

The plan on trading shall include the following main contents:

+ Information about the enterprise including name, address, phone number, fax number, e-mail address of the transaction office, representative office, branch, business location, website of the enterprise (if any) ) and other relevant information;

+ Area of ​​service provision;

+ System and method of service management and administration;

+ The service provision process includes the process of acceptance, transportation and delivery;

+ Methods of service provision organized by the enterprise or in cooperation with other enterprises (in case of cooperation with other enterprises, the enterprise applying for a postal license must detail the scope of cooperation and coordination in ensuring safety, security, settlement of complaints and compensation for damage to service users);

+ Measures to ensure safety for people, postal items, postal networks and information security in postal activities;

What is the charge (if any) for applying for a postal license in Vietnam?

Pursuant to subsection 1, Section 1, Part II of the List promulgated together with Decision 882/QD-BTTTT as follows:

New issuance:

+ Inter-provincial scope: 21,500,000 VND

+ International arrivals: 29,500,000 VND

+ International departure: 34,500,000 VND

+ Two-way international: 39,500,000 VND

- In case of transfer of the entire enterprises due to purchase, sale and merger of enterprises

+ Inter-provincial scope: 8,500,000 VND

+ International arrivals: 10,500,000 VND

+ International departure: 11,500,000 VND

+ Two-way international: 12,500,000 VND

The above collection rates follow the provisions of Circular 25/2020/TT-BTC dated April 14, 2020 of the Ministry of Finance amending and supplementing a number of articles of Circular No. 291/2016/TT-BTC dated November 15, 2016 on collection rate and the regulations on collection, payment, management and use of fees for appraisal of postal operation conditions.

Decision 882/QD-BTTTT takes effect from June 1, 2022.
