What are the regulations on the land price list for each type of land in Binh Duong province in the 2020 - 2024 period?

What do the land price list in Binh Duong province include?

According to Clause 1, Article 1 of the Regulation issued together with Decision 36/2019/QD-UBND of Binh Duong province, the prices of the agricultural land group list is divided into as follows:

- Price list of land for rice cultivation.

- Price list of land for other annual plants.

- Price list of land for perennial plants.

- Price list of production forest land.

- Price list of protective forest land.

- Price list of special-use forest land.

- Price list of land for aquaculture.

- Price list of other agricultural land (including land used to build greenhouses and other building types for cultivation purpose, including fanning not directly on the land, or to build breeding facilities for cattle, poultry and other animals as permitted by law; land for cultivation, breeding and aquaculture for the purpose of learning, research or experimentation; land for planting and nursing seedlings and breeders, and land for growing flowers and ornamental plants.).

Thus, there are 08 price tables for agricultural land group.

How to classify streets, areas and locations of agricultural land groups in Binh Duong province?

According to Clause 4, Article 1 of the Regulation issued together with Decision 36/2019/QD-UBND of Binh Duong province, the classification of streets, areas and locations of agricultural land groups is prescribed as follows:

Areas:

+ Area 1 : including land in communes and land located along the traffic road managed by the central government and province; land on the traffic roads in wards, townships, traffic hubs, commercial zones, industrial parks, industrial clusters, production zones, tourist areas, new residential areas.

+ Area 2: is the land in the communes and land located along the remaining roads.

Locations:

+ Location 1: The land plot is adjacent to the road and is within 50 meters of the roadway.

+ Location 2: The land plot is not adjacent to the road and is within 100 meters of the road safety corridor or the land plot behind location 1 is within 50 meters to 100 meters from the road safety corridor.

+ Location 3: The land plot is not adjacent to the road and is within 200 meters of the the road safety corridor or the part of the land plot behind location 2 is within the range from over 100 meters to 200 meters from the the road safety corridor.

+ Location 4: The land plot is not adjacent to the road and is more than 200 meters from the the road safety corridor or the remaining land plot behind location 3.

How to determine land unit price for agricultural land group in Binh Duong province?

According to Clause 5, Article 1 of Regulation issued together with Decision 36/2019/QD-UBND of Binh Duong province, the method of determining land unit price for agricultural land group is prescribed as follows:

- Determined by standard unit prices according to area and locations specified in Article 3 of this Regulation.

When determining the price of agricultural land belonging to routes or public paths with a road surface width of less than 4 meters (not yet named in the appendices), it shall be calculated according to the following formula:

What are the regulations on the application of land price list in Binh Duong province?

According to Article 2 of Decision 36/2019/QD-UBND of Binh Duong province, the implementation of the land price list is regulated as follows:

"Article 2.
1. When applying the price list of different types of land or facing difficulties or obstacles, the Departments of Natural Resources and Environment or the Divisions of Natural Resources and Environment of districts, towns and cities shall tke charge and coordinate with financial agencies and tax authorities at the same level and the People's Committees of communes, wards and townships where the land is located to consider and settle.
2. When determining financial obligations in each specific case or encountering problems with land prices, the Department of Natural Resources and Environment shall take charge and coordinate with the Department of Finance, Tax Department, and People's Committees of districts and towns, cities and People's Committees of communes, wards and townships where the land is located to determine the specific land price and submit it to the provincial People's Committee for decision.
3. During the application of the Land Price List, if the Government adjusts the land price bracket or the market price of land increases by 20% or more compared to the maximum land price or decreases by 20% or more compared to the maximum land price in the land price list for a period of 180 days or more, the Department of Natural Resources and Environment shall take charge for making an estimate and plan for developing an adjusting land price list and send it to the Provincial People's Committee to submit to the Standing Provincial People's Council to give opinions before deciding.
4. In the process of applying the price list of all types of land, if the competent authority adjusts the land use master plan and planning; changes the land use purpose and adds roads and streets that are not listed in the Price List of all types of land but do not fall into the cases specified in Clause 3 of this Article, The Department of Natural Resources and Environment shall base on the land price in the current land price list and the common transferable land price in the market to build a price list of additional land types and submit it to the provincial People's Committee for submission to the Standing Provincial People's Council for opinions before deciding.
5.The Department of Natural Resources and Environment shall organize an annual or periodic land price survey to monitor land price fluctuations compared with the maximum or minimum land price in the Land Price List."
