What are the regulations on the land price list for each type of land in Ben Tre province for the 2020 - 2024 period?

I would like to the regulations on the prices of agricultural land and residential land in special cases of Ben Tre province to grow coconut trees and produce brooms. Hoping to be answered! Thanks a lot!

What is land price list in Ben Tre province used for?

According to Clause 2, Article 1 of Regulation issued together with Decision 20/2020/QD-UBND, the land price list in Ben Tre province will be used as a basis for:

"Article 1. Scope of regulation
...
2. The land price list shall be used as a basis for:
Calculation of land use levy when the State recognizes land use rights of households and individuals for land areas within land use quotas, or permits change of land use purpose from agricultural land or non-agricultural land which is non-residential land to residential land for land areas within land allocation quotas applied to households and individuals;
b/ Calculation of land use tax;
c/ Calculation of charges and fees in land management and use;
d/ Calculation of fines for administrative violations in the field of land;
dd/ Calculation of indemnification paid to the State for damage caused in land management and use;
e Valuation of land use rights paid to the people who voluntarily return land to the State in case the returned land is allocated with land use levy, recognized of land use rights with land use levy, or leased land with full one-off rental payment for the entire lease period by the State.
g) Determination of the specific land price according to the land price adjustment coefficient method under Article 18 of Decree No. 44/2014/ND-CP dated May 15, 2014 of the Government on land price and Clause 4, Article 3 of Decree No.01/2017/ND-CP dated January 6, 2017 of the Government on amendments and supplementations of decrees detailing the implementation of the Land Law."

How to determine the price of non-agricultural land in special cases in Ben Tre province?

According to Article 9 of the Regulation promulgated together with Decision 20/2020/QD-UBND, for non-agricultural land without the price in Appendix VI, Annex VII, Article 5 of this Regulation, the determination of the location and road class is conducted under Article 8 of this Regulation as follows:

For non-agricultural land adjacent to streets, national highways and provincial roads:

- Location 1: It is calculated as twice the land price for each respective land type specified in Section D, Appendix VI, Appendix VII, Article 5 of this Regulation;

- Location 2: It is calculated at 60% of the land price for each respective type of land specified at Point a of this Clause;

- Location 3: It is calculated at 50% of the land price for each respective type of land specified at Point a of this Clause;

- Location 4: It is calculated at 40% of the land price for each respective type of land specified at Point a of this Clause;

- Location 5: It is calculated at 30% of the land price for each respective type of land specified at Point a of this Clause.

Note: In case the land price according to each of the above mentioned locations is lower than the land price specified in Section D of Appendix VI, Appendix VII, Article 5 of this Regulation, it shall be calculated by the land price specified in Section D, Appendix VI, Appendix VII, Article 5 of this Regulation.

For non-agricultural land adjacent to district roads, communal roads and inter-commune roads:

- Location 1: It is calculated as 1.6 times the land price for each respective land type specified in Section D, Appendix VI, Appendix VII, Article 5 of this Regulation;

- Location 2: It is calculated at 60% of the land price for each respective type of land specified at Point a of this Clause;

- Location 3: It is calculated at 50% of the land price for each respective type of land specified at Point a of this Clause;

- Location 4: It is calculated at 40% of the land price for each respective type of land specified at Point a of this Clause;

- Location 5: It is calculated at 30% of the land price for each respective type of land specified at Point a of this Clause.

Note: In case the land price according to each of the above mentioned locations is lower than the land price specified in Section D of Appendix VI, Appendix VII, Article 5 of this Regulation, it shall be calculated by the land price specified in Section D, Appendix VI, Appendix VII, Article 5 of this Regulation.

How to determine land prices by location for different types of land without the price bracket set by the government in Ben Tre province?

According to Article 10 of the Regulation issued together with Decision 20/2020/QD-UBND, the land price is determined in Appendix VIII, Article 5 of this Regulation, the location is determined as follows:

- Land of protection forests and special-use forests: Determine locations according to agricultural land group.

- Other agricultural land: Determine locations according to agricultural land group.

- Land for construction of office buildings; land for defense; land for security; land for construction of non-business works (land for construction of headquarters of non-business organizations, land for construction of cultural facilities, social service facilities, medical facilities, education and training, physical training and sports facilities, science and technology establishments, diplomatic establishments, and other non-business works); land used for mineral activities, land for construction materials, pottery making: Determine locations by non-agricultural land group.

- Land for public purposes (land for traffic, irrigation, historical and cultural relics, scenic, land for community activities, land for public amusement parks, energy works, postal and telecommunications, market, waste dump, waste treatment, land for other public works); land for religious establishments, belief establishments; land for cemeteries, graveyards, funeral homes, crematoriums, and other non-agricultural land: Determine locations by non-agricultural land group.

- Land of rivers, streams, canals, springs and special-use water surface used for aquaculture purposes shall be located according to agricultural land group; used for non-agricultural purposes: Located by non-agricultural land group.

- Unused land: Determine the location by type of land when the State allocates or leases land.
