What are the purposes of presentation of goods labels in Vietnam?
Pursuant to Article 3 of Decree 43/2017/ND-CP on goods labels:
Interpretation of terms
For the purposes of this Decree, the terms below shall be construed as follows:
1. Label means any manuscript, printed copy, drawing, photocopy of words, pictures, images that is stuck, printed, attached to, casted, or carved, a container of goods or on other kinds of materials to be attached to the goods or commercial container;
2. Presentation of goods labels means presenting essential information on a label about its contents so as to enable consumers to identify the goods, give suitable selection, consume, and use; to enable manufacturers and traders to advertise the goods; and to enable regulatory agencies to carry out the inspection and supervision;
3. Original label means the initial label that is attached to a goods or the goods' commercial package by the manufacturer;

Which entities have the responsibility for labeling for goods manufactured for domestic circulation in Vietnam?
Pursuant to Article 9 of Decree 43/2017/ND-CP (amended by Clause 4, Article 1 of Decree 111/2021/ND-CP) on responsibility for labeling for goods manufactured for domestic circulation:
Responsibility for labeling
1. The entity responsible for labeling shall, including supplementary label, shall ensure that the labeling is made truthful, clear, precise and correctly reflect the substance of the goods.
2. For goods manufactured for domestic circulation, the manufacturer shall be responsible for labeling.
The entity responsible for labeling shall keep assuming responsibility without regard to an authorization of labeling to another entity.
3. In case goods are not eligible for export and are returned for circulation in the country, organizations and individuals shall, before putting such goods into circulation, label them in accordance with the provisions of this Decree.
4. Organisations and individuals that import goods into Vietnam shall include the mandatory information on the labels of imported goods prescribed in this Decree.
For goods manufactured for domestic circulation, the manufacturer shall be responsible for labeling.
The entity responsible for labeling shall keep assuming responsibility without regard to an authorization of labeling to another entity.
Is it mandatory to display goods labels on electronic media in Vietnam?
Pursuant to Article 3 of Circular 18/2022/TT-BKHCN on rules for displaying mandatory information on electronic media:
Rules for displaying mandatory information on electronic media
1. Organizations and individuals responsible for goods labeling have the option of labeling on electronic media or on primary packaging or on commercial packages or in booklets of the goods in accordance with Decree No. 43/2017/ND-CP amended by Decree No. 111/2021/ND-CP. Goods categories and information thereof to be displayed on electronic media shall conform to the Appendix attached hereto.
2. Organizations and individuals responsible for goods labeling must fulfill the following requirements when labeling electronically:
a) The link to electronic media must be clearly shown on goods label, such as: code, barcode, QR code, on electronic visual display of goods that have a visual display, or via other common electronic media;
b) Provide sufficient means, equipment and/or instructions for customers to access the electronic information of goods label on the spot;
c) Information shown on electronic labels must match information shown on physical labels and must not cause readers, observers, listeners to misunderstand the nature of the goods.
Thus, Organizations and individuals responsible for goods labeling have the option of labeling on electronic media or on primary packaging or on commercial packages or in booklets of the goods in accordance with Decree No. 43/2017/ND-CP amended by Decree No. 111/2021/ND-CP.
Goods categories and information thereof to be displayed on electronic media shall conform to the Appendix attached to Circular 18/2022/TT-BKHCN.
Thus, organizations and individuals can label goods using one of the above methods.
