What are the prohibited acts on ID cards of professional servicemen in Vietnam?

Pursuant to the provisions of Article 6 of Decree 59/2016/ND-CP stipulating the ID cards of professional servicemen, national defense workers and officials, the following acts are strictly prohibited:

- Forging, falsifying the information, contents of ID cards of professional servicemen, national defense workers and officials.

- Destroying, appropriating, illegally using ID cards of professional servicemen, national defense workers and officials

- Initially issuing, replacing, reissuing, revoking, and temporarily seizing ID cards of professional servicemen, national defense workers and officials in violation of regulations of this Decree.

Thus, the above 03 cases are prohibited acts for ID cards of professional servicemen. Pay special attention to the case of forging, falsifying data, content of professional servicemen, national defense workers and officials.

What are the penalties of forging ID cards of professional servicemen in Vietnam?

According to the provisions of Article 14 of Decree 59/2016/ND-CP stipulating the ID cards of professional servicemen, national defense workers and officials (guided by Article 27 of Circular 218/2016/TT-BQP) as follows:

Handling violations
1. Professional servicemen, national defense workers and officials who use the ID cards for wrongful purposes, falsify, lend, lose or keep the ID cards when they are no longer in use shall, according to the nature and severity of the violation, incur disciplinary penalties or criminal prosecution in accordance with regulations of law.
2. Those who forge, destroy, keep or use the military ID cards of other people for any purposes shall, according to the nature and severity of the violation, incur disciplinary penalties or criminal prosecution in accordance with regulations of law.

Thus, for acts of forging professional military ID cards for any purposes shall, according to the nature and severity of the violation, incur disciplinary penalties or criminal prosecution in accordance with regulations of law.

What is the current regime of training and retraining professional servicemen in Vietnam?

Pursuant to the provisions of Article 35 of the Law on professional servicemen and women, national defense workers and official in 2015 prescribe the following regimes for training and retraining professional servicemen:

Training
1. Content, programs, manner and time of training for professional servicemen, National defense workers and officials shall be based on requirements for personnel structure of the People’s Army, job title standards, job positions and occupational titles.
2. The Minister of National Defense shall define the content, programs, manner of training after reaching agreement with the Ministry of Education and Training and other relevant ministries, sectors.
3. Professional servicemen, National defense workers and officials shall have following obligations and benefits during the time of training:
a) Comply strictly with regulations on training and disciplines of the army; and be subject to management by education and training establishments;
b) Enjoy full pay, allowances; have service time added to military service time as foundations for pay increase and promotion of ranks;

Thus, professional servicemen will enjoy the training and retraining regime as prescribed above.

What is the rest regime of professional servicemen in Vietnam?

Pursuant to the provisions of Article 35 of the Law on professional servicemen and women, national defense workers and official in 2015 (guided by Circular 113/2016/TT-BQP), the rest regime of professional servicemen, national defense workers and officials:

- Professional servicemen, national defense workers and officials are entitled to rest according to the provisions of the Labor Code and the regulations of the Minister of National Defense. In case the annual leave is not arranged due to the requirements of the task, in addition to the salary, an additional amount equal to the salary will be paid for the days without leave.

- When there is a mobilization order, during wartime and in a state of national defense emergency, the Minister of National Defense shall issue an order to suspend the implementation of the rest regime; professional servicemen, national defense workers and officials on leave must return to their units.

Thus, professional servicemen, will enjoy the rest regime according to the above provisions and detailed instructions in Circular 113/2016/TT-BQP.
