What are the procedures for licensing the import of cultural products for non-commercial purposes under the authority of the Ministry of Culture, Sports and Tourism of Vietnam?

Pursuant to the provisions in Part II of Administrative procedures for amendments, supplements and abolition in the fields of Fine Arts, Photography and Exhibitions under the scope of management functions of the Ministry of Culture, Sports and Tourism issued with Decision 3698/QD-BVHTTDL in 2023, the procedures for licensing the import of cultural products for non-commercial purposes under the authority of the Ministry of Culture, Sports and Tourism are as follows:

- The order of execution:

Individuals and organizations wishing to import cultural products in one of the following cases must submit an application for a license by mail or directly to the Department of Fine Arts, Photography and Exhibition:

+ Cultural products are visual works, applied arts, and photographic works for exchange, cooperation, and aid; Participate in exhibitions, competitions, and festivals at the national level.

+ Cultural products are visual works, applied arts, and photographic works specified in Clause 1, Article 6 of Decree 32/2012/ND-CP to serve the professional work or research of organizations. Ministries and branches at the Central Government, after asking for written opinions from relevant Ministries and branches;

+ Cultural products are visual works, applied arts, and photographic works for use or other purposes nationwide or in many different localities.

Within 02 working days from the date of receipt of complete and valid documents, the Department of Fine Arts, Photography and Exhibition issues the license. In case it is necessary to seek opinions from relevant ministries and branches, the licensing period may be extended no more than 10 working days. In case there is no license, there must be a document stating the reason.

- Performance:

Submit an application for a license to import cultural products by mail or directly to the Department of Fine Arts, Photography and Exhibition.

- Components and quantity of documents:

+ Profile components:

(1) Application for a license to import cultural products (form No. 01 symbol BM.NK, Appendix VI issued with Circular 13/2023/TT-BVHTTDL dated October 30, 2023 of the Minister of Culture Culture, Sports and Tourism amends and supplements regulations related to citizenship documents in a number of Circulars issued by the Minister of Culture, Sports and Tourism)

(2) Power of Attorney

(3) Copy of bill of lading or goods receipt, if any

+ Number of documents: (01) set

- Processing time: 02 working days from the date the application is valid.

+ In cases where opinions from other ministries and branches must be sought, the maximum time is 07 working days.

- Agencies carrying out administrative procedures:

+ Deciding authority: Department of Fine Arts, Photography and Exhibition

+ Agency directly implementing administrative procedures: Department of Fine Arts, Photography and Exhibition

- Result of administrative procedures: License to import cultural products

- Fees and charges: None

What are the regulations on customs procedures for import of cultural products in Vietnam?

Pursuant to the provisions of Article 11 of Decree 32/2012/ND-CP, customs procedures for import of cultural products are prescribed as follows:

(1) The import permit of cultural products granted by a state management agency of culture, sports and cultural is basis for Customs office to implement import procedures.

(2) Customs offices implement import procedures for cultural products in the following cases without requiring a permit of a state management agency of culture, sports and tourism:

- Cultural products being documents used for international seminar or conference already permitted to organize in Vietnam by a Vietnamese competent agency. The permit for such seminar or conference is basis for Custom office to solve import procedures;

- Cultural products with permits of publication, dissemination or publishing by competent agencies as prescribed by Vietnamese law;

- Cultural products being movable property of individuals, organizations;

- Cultural products being luggage carried along by passengers on entry;

- Cultural products being gifts or donations with values within the duty-free quota as prescribed by law.

(3) In case necessary to assess the content of cultural products specified in (2), the customs office of the locality where export procedures are implemented shall consult assessment opinions of state management agencies of culture, sports and tourism. Assessment records are basis for customs office to solve import procedures.

What are the cultural products prohibited from export or import in Vietnam?

Pursuant to the provisions of Clause 1, Article 6 of Decree 32/2012/ND-CP, It is strictly prohibited to export or import the following types of cultural products:

- Those with contents resist the State of the Socialist Republic of Vietnam, undermining the entire people's unity bloc;

- Those with contents inciting violence, propagating aggressive war, sowing hatred among nations and peoples of countries; inciting depravation and obscenity and crimes;

- Those containing state secrets;

- Those providing untruthful information, distorting the history, negating revolutionary achievements; offending great personalities and national heroes; slandering for aim of offending the prestige of organizations or the honor and dignity of citizens;

- Other types of cultural products prohibited by law from storing, dissemination and circulation in Vietnam.

Decision 3698/QD-BVHTTDL in 2023 will take effect from January 15, 2024
