Based on Sub-section 15.1, Section 15, Part B, Section II of the Administrative Procedures issued together with Decision 3384/QD-BCA-C07 in 2024, which guides the procedures for issuing certificates of training in fire prevention and fighting operations at the provincial level in Vietnam:

- Step 1: Individuals or organizations prepare the dossier as prescribed by law.

- Step 2: Individuals or organizations submit the dossier to the Fire Prevention, Fighting, and Rescue Police Department of the Provincial, City Police directly under the central government.

- Step 3: The receiving officer checks the legitimacy and components of the dossier (the documents in the dossier when sent to the Police agency must be originals or certified copies or photocopies accompanied by originals for the receiving officer to compare in case of direct submission or through public postal services; originals or electronic certified copies in case of online submission through the national public service portal, Ministry of Public Security public service portal).

+ If the dossier is legitimate and complete, a receipt for administrative procedure processing for fire prevention and fighting will be issued to the dossier submitter in one copy and one copy is kept on file, or a receipt notice is sent via email or mobile notification to the agency, organization, or individual submitting the dossier;

+ If the dossier is incomplete or not legitimate, it will be returned and instructions for completion provided; the information will be recorded in a supplemental guidance form, which is given to the dossier submitter in one copy and one copy is kept on file, or the supplemental guidance content is noted for notification via email or mobile phone to the agency, organization, or individual submitting the dossier.

- Step 4: On the appointment date noted on the administrative procedure processing receipt for fire prevention and fighting, or via email or mobile phone notification, individuals or organizations come to the submission place to directly receive results, or through public postal services, or receive electronic results on the public service account previously submitted.

- Implementation method:

+ Direct: Submit the dossier directly at the One-stop Department belonging to the Fire Prevention, Fighting, and Rescue Police Department of the provincial or city police directly under the central government.

+ Public postal services: Submit the dossier through public postal services.

+ Online: Submit the dossier at the National Public Service Portal, Ministry of Public Security Public Service Portal.

- Processing time limit:

+ No more than 05 working days from the date of receiving the complete dossier as prescribed.

+ In case the Certificate of Fire Prevention and Fighting Equipment Inspection is not issued, there must be a written response stating the reasons.

- Fees: No fee for issuing the Certificate of Fire Prevention and Fighting Equipment Inspection; the printing and sticking inspection stamp fees are specified in Circular 02/2021/TT-BTC on January 08, 2021 of the Ministry of Finance which prescribes fees, policies for collection, payment, management, and use of fire prevention and fighting equipment inspection fees.

Which authority has the power to issue certificates of training in fire prevention and fighting operations in Vietnam?

According to Clause 11, Article 38 of Decree 136/2020/ND-CP amended by Point d, Clause 13, Article 1 of Decree 50/2024/ND-CP, the issuance of certificates of training in fire prevention and fighting operations in Vietnam is regulated as follows:

- The Fire Prevention, Fighting, and Rescue Police Department of the Provincial Police shall issue certificates of training in fire prevention and fighting operations for fire prevention and fighting equipment specified in Appendix VII issued with Decree 50/2024/ND-CP of the agency, organization requesting an inspection certificate with fire prevention and fighting equipment sampled for inspection in the managed area.

- The Fire Prevention, Fighting, and Rescue Police Department of the provincial police has the authority to issue certificates of training in fire prevention and fighting operations for fire prevention and fighting equipment.

What is included in the application for issuing certificates of training in fire prevention and fighting operations in Vietnam?

According to Clause 5, Article 38 of Decree 136/2020/ND-CP amended by Point b, Clause 13, Article 1 of Decree 50/2024/ND-CP, the application for issuing certificates of training in fire prevention and fighting operations in Vietnam includes:

(1) Dossier for issuance of certificates of training in fire prevention and fighting operations according to the inspection results of a business providing technical inspection, examination, and advisory services in fire prevention and fighting includes:

+ A written request for issuing a Certificate of Fire Prevention and Fighting Equipment Inspection (Form PC27);

+ The inspection record of the fire prevention and fighting equipment by a business providing technical inspection, examination, and advisory services in fire prevention and fighting (Form PC25);

+ The sample collection record of the inspection equipment (Form PC28);

+ Certificate of origin (in case not connected with specialized databases) or factory exit certificate of the equipment;

+ Quality certificate of the equipment (if any);

+ Technical documents of the equipment requesting inspection;

(2) Dossier for issuance of certificates of training in fire prevention and fighting operations according to the inspection results of foreign agencies, organizations includes:

+ A written request for issuing a Certificate of Fire Prevention and Fighting Equipment Inspection (Form PC27);

+ Inspection results of foreign agencies, organizations with the tested technical criteria;

+ Certificate of origin (in case not connected with specialized databases) or factory exit certificate of the equipment;

+ Quality certificate of the equipment (if any); technical documents of the equipment requesting inspection;

(3) Documents in the dossier must be originals or certified copies or photocopies accompanied by originals for the receiving officer to compare. If the dossier is in a foreign language, there must be a Vietnamese translation and the requesting agency, organization, or individual must be responsible for the content of the translation.
