What is included in the application for a permanent residence card to foreigners in Vietnam?

Pursuant to subsection 15, Section A, Part II, Administrative procedures promulgated together with Decision 6968/QD-BCA in 2022, the application for a permanent residence card for foreigners includes the following documents:

- Application form for permanent residence status;

- Judicial record issued by the competent authority of the country of which the person is a citizen;

- A note from the representative agency of the country of which the person is a citizen, requesting that Vietnam settle for such person's permanent residence;

- Certified copy of passport;

- Papers proving eligibility to be considered for permanent residence as prescribed in Article 40 of the 2014 Law on entry, exit, transit and residence of foreigners in Vietnam.

- Letter of guarantee for foreigners specified in Clauses 1 and 2, Article 39 of the 2014 Law on entry, exit, transit and residence of foreigners in Vietnam.

What are the procedures for issuance of permanent residence cards to foreigners in Vietnam?

Pursuant to subsection 15, Section A, Part II, Administrative procedures promulgated together with Decision 6968/QD-BCA in 2022, the procedures for issuance of permanent residence cards to foreigners are prescribed as follows:

Step 1: Prepare documents according to the provisions of law.

Step 2: Submit the application at one of the two headquarters of the Immigration Department - Ministry of Public Security of Vietnam:

- No. 44-46 Tran Phu street, Ba Dinh district, Hanoi city.

- No. 333-335-337 Nguyen Trai Street, District 1, Ho Chi Minh City.

The officer receiving the application shall check the legality and content of the application:

- If the application is complete and valid, the application will be received, printed and issued an appointment letter to return results to the applicant; request to pay fees to toll collectors. The fee-collecting officer collects the money and hands over the receipt to the applicant.

- If the application is missing or invalid, the receiving officer will guide the applicant to complete the application.

Time to receive dossiers: From Monday to Saturday morning every week (except public holidays).

Step 3: The Immigration Department shall notify in writing the decision of the Minister of Public Security on the foreigner's application for permanent residence.

If accepted, within 05 working days from the date of receipt of the notice of the Immigration Department, the police department of the province or centrally run city where the foreigner applies for permanent residence shall notify the foreigner that he/she is eligible for permanent residence.

Step 4: Within 03 months after receiving the notice of settlement for permanent residence, the foreigner must go to the immigration management agency of the Police Department of the province or centrally run city where he/she applies for permanent residence to receive the permanent residence card:

The recipient gives the receipt, the money receipt for comparison. The officer returns the test results and asks to sign the receipt and return the permanent residence card to the person who comes to receive the results.

Time to return results: From Monday to Friday every week (except public holidays).

What is the time limit for processing the procedures for issuance of permanent residence cards to foreigners in Vietnam?

Pursuant to subsection 15, Section A, Part II, Administrative procedures promulgated together with Decision 6968/QD-BCA in 2022 as follows:

Within 04 months from the date of receipt of complete dossiers, the Minister of Public Security shall consider and decide to grant permanent residence; In case it is deemed necessary to carry out additional verification, the extension may be extended but must not exceed 02 months.
