Pursuant to the regulations in section 17 of Appendix A attached to Decision 1395/QD-BKHDT 2023, the procedures for implementing plans for programs/projects funded by ODA, concessional loans, and Vietnam's counterpart funds are as follows:

Implementation process:

- Within 30 days from the date of signing the specific international agreement, agreement on ODA and concessional loans, based on the Feasibility Study Report, Program/Project Document that has been approved, the program/project investment decision, and the specific international agreement, agreement on ODA and concessional loans for the program/project, the project owner coordinates with the foreign sponsor to establish or review and update the overall implementation plan for the program/project, and submits it to the managing agency for review and approval.

- Within 05 working days from the approval date of the overall implementation plan for the program/project, the program/project managing agency sends the approved decision along with the overall implementation plan for the program/project to the Ministry of Planning and Investment, the Ministry of Finance, and relevant agencies and foreign sponsors for monitoring, evaluation, and coordination in implementing the program/project.

Implementation method:

- Directly at the headquarters of state administrative agencies.

- Through the postal system.

The content of the annual implementation plan for the program/project, which includes detailed information on the components (divided into technical assistance and construction investment components), specific items and main activities, funding sources including counterpart funds, and the expected implementation progress.

Pursuant to the regulations in section 18 of Appendix A attached to Decision 1395/QD-BKHDT 2023, the procedures for implementing annual plans for programs/projects funded by ODA, concessional loans, and counterpart funds are as follows:

Step 1: Based on the approved overall implementation plan for the program/project by the managing agency and considering the actual disbursement situation and disbursement plan as per the international agreement, agreement on ODA and concessional loans for the program/project, the project owner reviews and submits the annual implementation plan for the program/project to the head of the managing agency for approval. The annual plans for implementation of programs/projects funded by ODA and concessional loans are part of the annual public investment plan of the managing agency.

Step 2: The managing agency reviews and approves the annual implementation plan for the program/project.

Step 3: Annually, during the preparation of the socio-economic development plan and state budget estimates as per the current regulations, the managing agency consolidates the annual implementation plan for the program/project into the public investment plan and the annual budget plan of the managing agency.

- For programs/projects fully financed by the state budget: Annually, at the same time as the preparation of the socio-economic development plan and state budget estimates, the project owner prepares the implementation plan for the program/project and submits it to the managing agency for approval of the ODA and concessional loans plan, which will be sent to the Ministry of Planning and Investment, the Ministry of Finance, and the authorized borrowing agency for monitoring and supervision. The managing agency and the project owner are responsible for providing counterpart funds in accordance with the implementation progress of the program/project.

- For programs/projects partially financed by the state budget: Depending on the nature of each component of the program/project (fully funded or partially financed), the project owner applies the planning and approval process for the corresponding component of the program/project as specified in Clauses 1, 2, and 7 of Article 43 of Decree 114/2021/ND-CP.

Step 4: Within 05 working days from the approval date of the annual implementation plan for the program/project, the project owner submits the approved decision along with the annual implementation plan to the managing agency, and through the managing agency, to the Ministry of Planning and Investment, relevant agencies, and foreign sponsors for monitoring, evaluation, and coordination in implementing the program/project
