What is the application for enjoying lump-sum social insurance benefits in Vietnam for employees who settle abroad?
Pursuant to the provisions of Clause 1, Article 60 of the Law on Social Insurance 2014 as follows:
Lump-sum social insurance allowance
1. Employees defined in Clause 1, Article 2 of this Law are entitled to a lump-sum social insurance allowance upon their request when falling in one of the following cases:
a/ They have reached the retirement age specified in Clause 1, 2 or 4, Article 54 of this Law but have paid social insurance premiums for under full 20 years, or the age specified in Clause 3, Article 54 of this Law but have paid social insurance premiums for under full 15 years and do not continue paying voluntary social insurance premiums;
b/ They settle abroad;
c/ They get a fatal disease, such as cancer, poliomyelitis, dropsy cirrhosis, leprosy, serious tuberculosis, or HIV infection progressing into AIDS, or other diseases as prescribed by the Ministry of Health;
d/ Employees defined at Points dd and e, Clause 1, Article 2 of this Law who are demobilized or cease working without being eligible for pension.
Accordingly, workers who go abroad to settle down are entitled to lump-sum withdrawal of social insurance when needed.
Pursuant to Decision 896/QD-BHXH 2021 on the list of online public services for administrative procedures under the jurisdiction of Vietnam Social Security.
According to Clause 14.2, subsection 14, Section III, Appendix to Administrative Procedures issued together with Decision 896/QD-BHXH 2021, the composition of the application for enjoying lump-sum social insurance benefits in Vietnam for employees who settle abroad include:
- Original of Social Insurance Book.
- Original Application Form
- A copy of the certification of a competent authority on renunciation of Vietnamese nationality or a certified or notarized Vietnamese translation of one of the following papers:
+ Passport issued by a foreign country
+ Visas issued by competent foreign agencies certifying the entry permit for the reason of residence abroad.
+ Papers certifying that they are carrying out procedures for naturalization of foreign countries; certification papers or permanent residence cards with a term of 05 years or more issued by a competent foreign agency.
- The original personal statement of the time and area serving in the Army with regional allowances, for those who have served in the Army before January 1, 2007 in the area receiving the regional allowance where the social insurance book does not fully show information as a basis for calculating regional allowances.

What are the procedures for enjoying lump-sum social insurance benefits in Vietnam for employees who settle abroad in 2023?
Pursuant to Clause 14.2, subsection 14, Section III, Appendix to Administrative Procedures issued together with Decision 896/QD-BHXH 2021.
Procedures for enjoying lump-sum social insurance benefits for employees who settle abroad shall be carried out according to the following contents:
(1) Order of execution
- Step 1. Prepare and submit dossier: The employee makes a dossier according to regulations (in the section Components of application) and submits it to the social insurance agency where he/she resides.
- Step 2. The social insurance agency receives the dossier and settles it according to regulations.
- Step 3. Receive results: Employees receive settlement results from the social insurance agency.
(2) Time limit for settlement
Maximum 05 working days from the date the social insurance agency receives the complete application as prescribed
(3) Result of settlement
- Decide on lump-sum social insurance benefits;
- A copy of the process of paying social insurance premiums;
- Subsidy.
How to carry out the procedure for enjoying lump-sum social insurance benefits in Vietnam for employees who settle abroad in 2023?
The method of carrying out the for enjoying lump-sum social insurance benefits for employees who settle abroad is determined according to Clause 14.2, subsection 14, Section III, Appendix to Administrative Procedures issued together with Decision 896/QD-BHXH 2021 as follows:
(1) Submission of application: Employees submit dossiers in one of the following forms:
- Via electronic transactions: Employees register to receive authentication codes and send electronic documents to the Public Service Portal of Vietnam Social Security or through I-VAN Organization (if they have registered to use I-VAN services);
in case paper documents are not converted to electronic format, all paper dossiers shall be sent to the social insurance agency by post;
- Via Postal.
- Directly at the social insurance agency.
(2) Receive results: Employees receive:
- Relevant documents in the registered form (directly at the social insurance agency or by post or via electronic transaction);
- Allowance: Directly at the social insurance agency or through postal service or through a personal account.
In case the beneficiary authorizes another person to receive the payment on his/her behalf, comply with the procedure "Authorization to receive social insurance and unemployment benefits" or the original of the authorization contract as prescribed by law.
