Pursuant to the latest guidance in Decision 320/QD-BCA in 2024, the procedure for declaring residence information for persons who fail to meet the conditions for permanent or temporary residence registration in 2024 is as follows:

- Step 1: Persons or organizations prepare the necessary documents according to legal regulations.

- Step 2: Persons or organizations submit the documents to the commune-level police station.

- Step 3: When receiving the declaration of residence information for persons who fail to meet the conditions for permanent or temporary residence registration, the registration agency checks the legality and content of the documents:

+ If the documents are complete and valid, the registration agency accepts the documents, issues a Receipt of Document Submission, and sets an appointment to return the result (according to Form CT04 issued with Circular 66/2023/TT-BCA) to the applicant.

+ If the documents meet the conditions but are incomplete, the registration agency guides the applicant to supplement and complete the documents and issues a Guidance for Document Supplement and Completion (according to Form CT05 issued with Circular 66/2023/TT-BCA).

+ If the documents do not meet the conditions, the registration agency rejects the application and issues a Receipt of Rejection and Document Resolution (according to Form CT06 issued with Circular 66/2023/TT-BCA) to the applicant.

- Step 4: Based on the appointment date on the Receipt of Document Submission and Appointment to Return the Result, the applicant receives a notification of the result of the registration procedure (if applicable).

Implementation method:

- Submit the documents directly to the commune-level police station.

- Submit the documents online through online public service portals such as the National Public Service Portal, the Ministry of Public Security's Public Service Portal, VNeID application, or other online public service platforms as prescribed by law.

Pursuant to Decision 320/QD-BCA in 2024, the documents required for declaring residence information for persons who fail to meet the conditions for permanent or temporary residence registration in 2024 are as follows:

Documents required:

- Declaration form for changing residence information (Form CT01 issued with Circular 66/2023/TT-BCA).

- Other documents, if applicable.

Number of sets of documents: 01 (one) set

Processing time:

- For cases where citizens already have information in the national population database, the registration agency must verify the information within 05 working days from the date of receiving the declaration.

- For cases where citizens do not have information in the national population database, the registration agency must verify the information within 30 days from the date of receiving the declaration. In complex cases, the processing time may be extended but not exceeding 60 days.

After verifying and confirming the information, the registration agency updates the citizen's information on current residence and other details in the national population database and the residence database. They also notify the individual who made the declaration about the updated information and provide a confirmation of residence information to the citizen.

Where is the place of residence of persons without permanent and temporary residences in Vietnam?

Pursuant to Article 19 of the Law on Residence 2020, it is stipulated:

Place of residence of persons without permanent and temporary residences
1. The place of residence of a person without permanent and temporary residences as they are ineligible for permanent and temporary residence registration shall be their current residence; if they do not live at a certain address, their current residence shall be the commune-level administrative unit where they are living. Persons without permanent and temporary residences must declare information on their residence with the registration authority of the locality where their current residence is located.
2. Registration authorities shall provide instructions on residence information declaration based on the information fields in the national population database and residence database.
3. In case the person provided for in Clause 1 herein does not have their information recorded in the national population database and/or residence database, within 30 days starting from the date of receipt of declared information, the registration authority shall verify the information; for complicated cases, this time limit may be extended up to a total of 60 days.
4. In case the person provided for in Clause 1 herein has had their information recorded in the national population database and residence database, within 05 working days starting from the date of receipt of declared information, the registration authority shall verify the information.
5. After verifying, the registration authority shall update information on the declarant's current residence and other information into the national population database and residence database and notify the declarant of such update.
6. If there is any change to residence information, citizens must notify the registration authority to have their information in the national population database and residence database revised; and carry out the permanent or temporary residence registration procedures when eligible as per regulations of this Law.

Thus, the place of residence of a person without permanent and temporary residences as they are ineligible for permanent and temporary residence registration shall be their current residence; if they do not live at a certain address, their current residence shall be the commune-level administrative unit where they are living. Persons without permanent and temporary residences must declare information on their residence with the registration authority of the locality where their current residence is located.
