a) A submission from the Standing Committee of the National Assembly requesting the National Assembly to decide to shorten or extend the term of the National Assembly and the People's Council;

b) Draft resolution;

c) Other documents (if any).

The Procedure for the National Assembly of Vietnam to Decide to Shorten or Extend the Term of the National Assembly and the People's Council

Pursuant to Clause 2, Article 55 of the Regulations on the Sessions of the National Assembly issued with Resolution 71/2022/QH15 as follows:

Deciding to Shorten or Extend the Term of the National Assembly and the People's Council

2. The National Assembly decides to shorten or extend the term of the National Assembly and the People's Council according to the following procedure:

a) A representative of the Standing Committee of the National Assembly presents the submission;

b) Before discussing at the plenary session of the National Assembly, National Assembly members may discuss at the delegations of National Assembly members, groups of National Assembly members;

c) The Standing Committee of the National Assembly reports to the National Assembly on the explanation, acceptance of comments from National Assembly members, and amendment of the draft resolution;

d) The National Assembly votes to pass the draft resolution.

Therefore, the National Assembly decides to shorten or extend the term of the National Assembly and the People's Council according to the following procedure:

- A representative of the Standing Committee of the National Assembly presents the submission;

How Long is the Term of the National Assembly of Vietnam?

Pursuant to Article 2 of the Law on Organization of the National Assembly 2014 which stipulates the term of the National Assembly as follows:

Term of the National Assembly

1. The term of each session of the National Assembly is 05 years, from the opening date of the first session of that term to the opening date of the first session of the next term.

2. Sixty days before the end of its term, the new term of the National Assembly must be elected.

3. In special cases, if at least two-thirds of the total number of National Assembly members vote in favor, the National Assembly can decide to shorten or extend its term at the request of the Standing Committee of the National Assembly. The extension of a term shall not exceed 12 months, except in cases of war.

Therefore, the term of each session of the National Assembly is 05 years, from the opening date of the first session of that term to the opening date of the first session of the next term.

What is the Procedure for the National Assembly of Vietnam to Issue a Session Resolution?

Pursuant to Clause 2, Article 57 of the Regulations on the Sessions of the National Assembly issued with Resolution 71/2022/QH15 as follows:

- The President, the Standing Committee of the National Assembly, the Government of Vietnam, the Prime Minister, the Central Committee of the Vietnam Fatherland Front, and the central bodies of member organizations of the Front, the Supreme People's Court, the Supreme People's Procuracy, the State Audit, the Ethnic Council, Committees of the National Assembly, National Assembly members have the right to propose content for inclusion in the draft resolution of the National Assembly session;

- Committees of the National Assembly examine as prescribed by law or Committees of the National Assembly, Sub-Committees of the Standing Committee of the National Assembly give written opinions on the proposed content within their areas of responsibility; proposed content must be submitted to the National Assembly for consideration and discussion;

- The General Secretary of the National Assembly presides over assisting the Standing Committee of the National Assembly in aggregating proposed contents and drafting the session resolution of the National Assembly; collects opinions from the President, the Government of Vietnam, the Prime Minister, the Central Committee of the Vietnam Fatherland Front, the Supreme People's Court, the Supreme People's Procuracy, the State Audit, the Ethnic Council, Committees of the National Assembly, Sub-Committees of the Standing Committee of the National Assembly, relevant agencies, organizations, and reports to the Standing Committee of the National Assembly for consideration and decision;

- The Standing Committee of the National Assembly collects opinions from National Assembly members on the draft resolution;

- The Standing Committee of the National Assembly reports to the National Assembly on the explanation, acceptance of comments from National Assembly members, and amendment of the draft resolution;

- The National Assembly votes to pass the draft resolution.
