What are the regulations on the change of professional titles of public employees in Vietnam?

Pursuant to the provisions of Article 30 of Decree 115/2020/ND-CP on the change of professional titles of public employees as follows:

Change of professional titles of public employees

1. The change of professional titles of public employees is carried out when the public employee changes his/her working position but the current professional title does not match the requirements of the new job position.

2. Public employees to be considered for change of professional titles must fully satisfy the criteria for changed professional titles.

3. The head of the public non-business unit shall decide or request the competent authority to decide on the consideration of the change of professional titles according to the decentralized competence.

4. When considering changing professional titles, it is not combined with salary increase.

Thus, the consideration of changing professional titles for public employees is carried out according to the above provisions.

Public employees who are considered for a change of professional titles must satisfy the criteria for the changed professional titles.

Pursuant to the provisions of Article 2 of Circular 49/2022/TT-BGTVT, professional titles of public employees specialized in railway project management include:

- Grade 1 railway project manager

- Grade 2 railway project manager

- Grade 3 railway project manager

- Grade 4 railway project manager.

Accordingly, the codes of professional titles are as follows:

Regarding the salary coefficient, Clause 2, Article 9 of Circular 49/2022/TT-BGTVT stipulates that the salary calculation for professional titles of public employees specialized in railway project management will apply the Salary Table according to Table 3 attached to Decree 204/2004/ND-CP.

What is the latest regulation on salary calculation for public employees whose professional titles are changed to railway project manager in Vietnam?

According to Article 8 of Circular 49/2022/TT-BGTVT, the salary calculation of professional titles of railway project management officers must be based on the job position, professional and professional responsibilities, and fully meet the standards as prescribed in Circular 49/2022/TT-BGTVT.

For public employees who are changed from one position to another: When changering to a professional title, a railway project manager specialized in railway project management may not combine salary increases or promotion to public employee professional titles.

Accordingly, regulations on salary calculation for public employees changed to railway project management are defined in Clause 3, Article 9 of Circular 49/2022/TT-BGTVT as follows:

3. Salary calculation for railway project management public employees currently holding salaries in the ranks of civil servants and public employees currently holding to the professional titles of railway project management public employees specified in this Circular This is done in accordance with the guidance in Clause 2, Section II, Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Minister of Home Affairs guiding salary grading when raising ranks, changing ranks, changing types of civil servants, officers, as follows:

a) Salary calculation of the professional title of Grade I Railway Project Manager, code V.12.11.01, for public employees currently ranked A3, group 1 (A3.1);

b) Salary calculation of the professional title of Grade II Railway Project Manager, code V.12.11.02, for public employees currently ranked A2, group 1 (A2.1);

c) Salary calculation of the professional title of Grade III Railway Project Manager, code V.12.11.03, for public employees currently ranked A1;

d) Salary calculation of the professional title of Grade VI Railway Project Manager, code V.12.11.04, for public employees currently ranked A0.

Thus, according to the above regulations, public employees who change rank to railway project manager will be ranked as follows:

- Salary calculation of the professional title of railway project manager, grade 1, code V.12.11.01: for public employees currently ranked A3, group 1 (A3.1);

- Salary calculation of the professional title of railway project manager, grade 2, code V.12.11.02: for public employees currently ranked A2, group 1 (A2.1);

- Salary calculation of the professional title of railway project manager, grade 3, code V.12.11.03: for public employees currently ranked A1;

- Salary calculation of the professional title of railway project manager, grade 4, code V.12.11.04: for public employees currently ranked A0.

Circular 49/2022/TT-BGTVT takes effect from March 1, 2023.
