What are the penalties for using the Miss title in Vietnam after it has been revoked?

According to the provisions of Clause 3, Article 11 Decree 38/2021/ND-CPP as follows:

Violations on performing arts, competitions, and festivals of various types of performing arts

...

3. A fine ranging from VND 15,000,000 to VND 20,000,000 shall be imposed for any of the following acts:

a) Failure to revoke the title, award of competitions, and festivals of various types of performing arts when there is a written request for revocation from a competent state agency;

b) Failure to publicly announce on the mass media about the revocation of the title, award of competitions, and festivals of various types of performing arts;

c) Using the title, award of competitions, and festivals of various types of performing arts after being revoked or having a decision to cancel the results of the competitions, and festivals of various types of performing arts.

According to the above regulations, the act of using the Miss title after being revoked can be subject to an administrative fine ranging from VND 15,000,000 to VND 20,000,000.

Note: The above administrative fine level is for individuals; for organizations, this administrative fine will be doubled (based on the provisions of Article 5 Decree 38/2021/ND-CP amended by Clause 2, Article 1 Decree 128/2022/ND-CP).

According to the provisions of Clause 10, Article 11 Decree 38/2021/ND-CP (supplemented by Clause 4, Article 4 Decree 129/2021/ND-CP and point a, Clause 4, Article 2 Decree 128/2022/ND-CP) as follows:

Violations on performing arts, competitions, and festivals of various types of performing arts

10. Remedial measures:

a) Compulsory revocation of the approval document for organizing performing arts; the approval document for organizing competitions, and festivals of various types of performing arts for the act specified at point a, Clause 1 of this Article if it has been granted;

b) Compulsory apology to organizations and individuals in writing for the act specified at point c, Clause 3 of this Article;

c) Compulsory revocation of titles and awards for the act specified at point a, Clause 3 of this Article;

d) Compulsory public announcement about the revocation of titles and awards for the act specified at point b, Clause 3 of this Article;

đ) Compulsory repayment of illegal profits obtained from committing the acts specified at point a, Clause 3; Clauses 4, 5, 6, 7, and 8 of this Article.

e) Compulsory submission of the altered, erased or supplemented approval document, which changes the content to the competent authority that issued the approval document for the act specified at point b, Clause 2 of this Article.

The act of using the revoked Miss title will be required to issue an apology to the organizations and individuals in writing.

Vietnam: Will the competition results be canceled if there is an official request to revoke the Miss title but failing to comply with?

According to the provisions of Article 18 Decree 144/2020/ND-CP as follows:

Revocation of titles, awards, cancellation of competition results, festivals of various types of performing arts, beauty, and model competitions

1. Competent state agencies as specified in Clause 2, Article 17 of this Decree shall request in writing the revocation of titles, and awards to the organizing individuals and organizations when one of the following cases is detected:

a) Individuals achieving titles, awards violate the provisions of Article 3 of this Decree;

b) Titles and awards were granted at competitions and festivals not in line with the content of the proposals according to the application dossier for approval documents or the content announced.

2. Organizing individuals and organizations shall revoke titles, and awards as requested by competent state agencies, publicly announce it on the mass media and be responsible for ensuring the rights of the related organizations and individuals according to the provisions of the law.

3. If the revocation is not implemented, the competent state agencies as specified in Clause 2, Article 17 of this Decree shall decide to cancel the competition results, festivals after 05 working days from the date of the written request for revocation and post the information canceling the competition results, festivals on the electronic information system of the competent state agencies.

According to the above regulations, if the organizing individuals and organizations of the Miss competition do not comply with the written revocation request from the competent state agency, then after 05 working days from the date of the written revocation request and posting of the information canceling the competition results on the electronic information system of the competent state agencies, the competent state agencies shall decide to cancel the results of the Miss competition.
