* Minimum conditions for establishing a branch:
Pursuant to the provisions of Clause 4, Article 17 of the Charter of the Ho Chi Minh Communist Youth Union (guided by Item b, point 11.2, Clause 11 of Guidance 16-HD/TWDTN-BTC of Vietnam in 2018) as follows:
4. Units with three or more unionists may establish a branch of the Youth Union. If there are not enough three unionists, the superior Union will introduce them to an appropriate grassroots organization. Branches may form sub-groups.
* Conditions for establishment of grassroots groups:
Pursuant to the provisions of Clause 5 Article 17 of the Charter of the Ho Chi Minh Communist Youth Union (guided by Item a, point 11.2, Clause 11 of Guideline 16-HD/TWDTN-BTC of Vietnam in 2018) as follows:
11.2. Article 17 (clauses 4 and 5).
a. The grassroots union is the direct superior of the branch. An organization with 02 or more branches and at least 30 unionists shall establish a grassroots union.
- For communes, wards and townships with 02 or more branches but not enough 30 unionists, they still establish grassroots unions.
- In particular units, the grassroots delegation may request the establishment of a divisional group (for units with a corresponding party committee at the same level) and request recognition by the immediate superior delegation. The divisional delegation is responsible for organizing the implementation of resolutions of the grassroots delegation. Duties, powers, organizational structure, seal and term of office of divisional unions shall be applied in the same way as that of grassroots delegations.
Thus, the minimum condition for establishing a branch is that the unit must have 03 or more unionists. In case the minimum conditions for the establishment of a branch are not met, the superior Union shall refer them to an appropriate grassroots organization.

c. For union officials and unionists
- Reprimand: applies to union officials and unionists who suffer from a defect for the first time, a short-term defect, a short-term harmful influence, who has noticed the defect and is determined to correct it.
- Warning: applied to cadres and unionists who violate discipline and are reprimanded but continue to commit them again, or even though the violation is relatively serious for the first time, the scope of influence is relatively wide.
- Demotion: applied to union officials who commit serious defects that adversely affect the Union organization and are not worthy to hold that position.
When applying the dismissal discipline, attention should be paid to officials holding multiple positions, specifically as follows:
+ Cadres holding many positions who violate discipline shall, depending on the nature and seriousness of their violations, be removed from one position, many positions or from the position the Union is currently holding.
+ In case a union cadre holds many positions in a level such as secretary (or deputy secretary), standing committee unionist, executive committee unionist... when violating discipline, they must be dismissed: the position of secretary (or deputy secretary) is also a unionist of the standing committee and a unionist of the executive committee; if dismissing a standing committee unionist who is still a unionist of the executive committee; if dismissed from the executive committee unionist, all positions will be terminated.
+ In case a cadre holding multiple positions at many levels, when violating discipline, must be dismissed, then the dismissal at any level will only lose his position at that level, the positions at other levels will remain.
+ In case an official is both a unionist of the Executive Committee and a unionist of the Inspection Committee at the same level, when violating discipline, he must be dismissed; if dismissing a unionist of the inspection committee, depending on the seriousness of the violation, it is recommended that the union level consider the status of an executive committee unionist.
- Exclusion:
+ Is the highest form of discipline of the Union, applied to union officials and unionists who commit very serious defects that adversely affect the Union organization and do not deserve to be in the ranks of the Ho Chi Minh Communist Youth Union.
+ Union unionists expelled, after one year, will be considered for re-admission. The time of expulsion does not include membership age.
Thus, for unionists, 03 forms of discipline will be applied: reprimand, warning, expulsion.
What are the principles of the collection of union fees?
Pursuant to the provisions of Article 41 of the Charter of the Ho Chi Minh Communist Youth Union (guided by clause 32 of Guideline 16-HD/TWDTN-BTC of Vietnam in 2018) as follows:
Principles of Union fee collection
32.1. Rules.
a. Every month, the unionists pay the union fee for the branch. In case the unionists have difficult circumstances, they will be considered by the grassroots union executive committee to exempt the union fee for a certain period of time but not exceeding 6 months.
b. The branch is responsible for collecting the union fee of its unionists once a month.
32.2. Membership fee level.
In accordance with current regulations, based on the actual situation, the Secretariat of the Central Committee of the Union will submit to the Standing Committee of the Central Committee of the Union for consideration and adjustment of the reasonable payment rate.
32.3. The deduction and payment of union fees to the superior delegation.
All levels of unions from the branch and above must deduct and pay the union fee to the superior union. The deductions are prescribed as follows:
a. Deduction level: From the branch and above, each level is allowed to keep two thirds (2/3) and submit one third (1/3) of the union fee paid by the union members or deducted from the lower level union. Partial and grassroots delegations are assigned the right to retain two-thirds (2/3) of the union fees of their level.
b. Deduction time:
- The branch deducts and pays the union fee to the grassroots union (the grassroots union, the divisional union) once a month.
- The grassroots delegation, district level and equivalent once every 3 months.
- Provinces, city unions and equivalent levels deduct and pay union fees to the Central Youth Union 1 to 2 times a year, the last payment deadline is December 30 every year.
Thus, the payment of union fees is made according to the above principles.
