Pursuant to Article 3 of Circular 12/2022/TT-BGTVT stipulating as follows:
“Article 3. Principles for managing the list of potentially unsafe products and goods under the state management responsibility of the Ministry of Transport
1. The list of products and goods specified in Appendix I to this Circular shall apply the following principles:
a) Imported products and goods must be certified for quality, technical safety and environmental protection according to regulations before customs clearance;
b) Products and goods manufactured and assembled domestically must be certified for quality, technical safety and environmental protection according to regulations before being put on the market.
2. The list of products and goods specified in Appendix II to this Circular shall apply the following principles:
a) Imported products and goods must be certified for quality, technical safety and environmental protection as prescribed, except for the case specified at Point b of this Clause
b) The imported products and goods specified in Section E, Appendix II issued together with this Circular for replacement or warranty service, and the quantity of products and goods of the same type in a consignment shall be limited to less than 100. Importing organizations and individuals shall be entitled to announcement of technical-regulation conformity on the basis of the results of self-assessment of conformity or certified for technical safety and environmental protection according to regulations if such organizations or individuals have demand;
c) The time of certification or announcement of technical-regulation conformity at Points a and b of this Clause is made after the imported products and goods are cleared from customs and before being put on the market;
d) Products and goods manufactured and assembled domestically must be certified for quality, technical safety and environmental protection according to regulations before being put on the market.
3. The Vietnam Register shall receive dossiers of announcement of regulation conformity for products and goods according to the provisions of law.”
Accordingly, the Ministry of Transport will manage the list of potentially unsafe products in Vietnam and goods in accordance with the above-mentioned principles.

What is the application of the list of potentially unsafe products and goods under the management of the Ministry of Transport?
Pursuant to Article 4 of Circular 12/2022/TT-BGTVT stipulating as follows:
“Article 4. Application principles
1. Imported products and goods on the list specified in Appendix I and Appendix II issued together with this Circular must be registered for state inspection of product and goods quality.
2. In case products and goods show only 4-digit HS codes, all 8-digit codes belonging to 4-digit code groups shall apply if they are consistent with the names stated in the quality certificate.
3. In case products and goods show only 6-digit HS codes, all 8-digit codes belonging to 6-digit code group shall apply if they are consistent with the names stated in the quality certificate.
4. In case the HS code specified in Appendix I, Appendix II issued together with this Circular is different from the HS code in the List of products and goods for export and import of Vietnam promulgated by the Ministry of Finance, the application shall apply. used according to the HS code issued by the Ministry of Finance.”
Accordingly, the application of the list of potentially unsafe products in Vietnam and goods under the management of the Ministry of Transport will follow the principles specified above.
