Vietnam: How many days in advance do employees notice their employers in case of terminating the employment contract?

Pursuant to the provisions of Article 35 of the 2019 Labor Code, regulations on the right of an employee to unilaterally terminates the employment contract are as follows:

The right of an employee to unilaterally terminates the employment contract
1. An employee shall have the right to unilaterally terminate the employment contract, provided he/she notices the employer in advance:
a) at least 45 days in case of an indefinite-term employment contract;
b) at least 30 days in case of an employment contract with a fixed term of 12 – 36 months;
c) at least 03 working days in case of an employment contract with a fixed term of under 12 months;
d) The notice period in certain fields and jobs shall be specified by the government.
2. An employee is shall have the right to unilaterally terminate the employment contract without prior notice if he/she:
a) is not assigned to the work or workplace or not provided with the working conditions as agreed in the employment contract, except for the cases specified in Article 29 of this Labor Code;
b) is not paid adequately or on schedule, except for the case specified in Clause 4 Article 97 of this Code.
c) is maltreated, assaulted, physically or verbally insulted by the employer in a manner that affects the employee’s health, dignity or honor; is forced to work against his/her will;
d) is sexually harassed in the workplace;
dd) is pregnant and has to stop working in accordance with Clause 1 Article 138 of this Labor Code.
e) reaches the retirement age specified in Article 169 of this Labor Code, unless otherwise agreed by the parties; or
g) finds that the employer fails to provide truthful information in accordance with Clause 1 Article 16 of this Labor Code in a manner that affects the performance of the employment contract.

Thus, based on the above regulations, except for cases where prior notice is not required as prescribed above, an employee shall have the right to unilaterally terminate the employment contract, provided he/she notices the employer in advance:

- at least 45 days in case of an indefinite-term employment contract;

- at least 30 days in case of an employment contract with a fixed term of 12 – 36 months;

- at least 03 working days in case of an employment contract with a fixed term of under 12 months;

- The notice period in certain fields and jobs shall be specified by the government.

Vietnam: What are the resignation procedures for officials and public employees who wish to resign?

Pursuant to Decision 507/QD-BNV 2023, the procedures for resignation, stepping down from managerial positions, and leaving the job for officials and public employees are as follows:

(1) For officials:

- Process for considering stepping down:

+ Officials in leadership or managerial positions submit a resignation letter.

+ Within 10 days from the date of receiving the resignation letter from officials, the advisory agency on personnel organization or the head of the agency or organization where the officials are working must discuss with the officials who submitted the resignation letter.

If officials withdraw their resignation, the evaluation process will be stopped. If officials do not withdraw their resignation, the advisory agency on personnel organization will consider and propose to the competent authority according to the hierarchical management of officials.

+ Within 15 days from the date the advisory agency on personnel organization submits a written proposal, the leadership collective of the agency or organization with authority must discuss and vote by secret ballot.

The decision for officials to step down must be agreed upon by over 50% of the total members of the leadership collective; if personnel reach a ratio of 50%, the decision will be made by the head of the agency.

- Process for resignation:

+ Officials must submit a letter to the competent agency, organization, or unit.

+ Within 30 days from the date of receiving the letter, if officials are allowed to leave the job, the competent agency, organization, or unit will issue a written decision to terminate the employment. If officials are not allowed to leave the job, a written response must be provided, stating the reasons according to the regulations in Point c, Article 4 of Decree 46/2010/ND-CP.

(2) For public employees:

- Process for considering stepping down from managerial positions for public employees:

+ Public employees in managerial positions submit a letter requesting to step down.

+ Within 10 days from the date of receiving the letter requesting to step down from public employees, the advisory department on personnel organization or the head of the public institution where the public employees are working must discuss with the public employees who submitted the request.

If public employees withdraw their request, the evaluation process will be stopped. If public employees do not withdraw their request, the advisory department on personnel organization will consider and propose to the head of the public institution or the competent authority according to the hierarchical management of personnel.

+ Within 15 days from the date the advisory department on personnel organization submits a written proposal, the leadership collective of the agency or unit with authority must discuss and vote by secret ballot.

The decision for public employees to step down from managerial positions must be agreed upon by over 50% of the total members of the leadership collective; if the ratio reaches 50%, the decision will be made by the head of the public institution

- Process for resignation

+ Public employees submit a written request.

+ Within 5 working days from the date of receiving the request from public employees, if they are allowed to leave the job, the head of the public institution will terminate the employment contract and handle the resignation benefits for public employees according to the regulations.

+ If public employees are not allowed to leave the job, a written response must be provided, stating the reasons according to the regulations.
