What are authorities that has power to recruit officials in Vietnam?
Based on Article 39 of the Law on Cadres and Civil Servants 2008 amended by Clause 6, Article 1 of the Law on Amendments to the Law on Cadres and Civil Servants and the Law on Public Employees 2019, the authorities that has power to recruit officials in Vietnam include:
- The Supreme People's Court, the Supreme People's Procuracy, and the State Audit Office of Vietnam recruit and decentralize recruitment of officials within the agencies, organizations, and units under their management;
- The Office of the National Assembly and the Office of the President conduct recruitment of officials within the agencies and units under their management;
- Ministries, ministerial-level agencies, agencies under the Government of Vietnam, and organizations founded by the Government of Vietnam or the Prime Minister of Vietnam that are not public service providers recruit and decentralize recruitment of officials within the agencies, organizations, and units under their management;
- Provincial People's Committees recruit and decentralize recruitment of officials within the agencies, organizations, and units under their management;
- Agencies of the Communist Party of Vietnam, the central agencies of the Vietnam Fatherland Front, and socio-political organizations recruit and decentralize recruitment of officials within the agencies, organizations, and units under their management.

What are the details of the latest regulations on the consideration of promoting more than 7,000 public employees to officials under Official Dispatch 5578/VPCP-TCCV in 2024?
The promotion of public employees to officials is stipulated in Official Dispatch 5578/VPCP-TCCV in 2024 regarding the management work of staffing and the construction of job positions.
On July 23, 2024, the Party Committee of the Government of Vietnam received Conclusion 01-KL/BCĐ from the Central Steering Committee on staff management about concluding the 3rd meeting regarding the results of staff management in the political system.
To perform the tasks assigned in the above Conclusion, the Secretary of the Party Committee of the Government of Vietnam and the Prime Minister of the Government of Vietnam have the following opinions:
(1) Assign the Ministry of Home Affairs:
- To take the lead, cooperate with ministries, central authorities, and local authorities to base on the number of staff quotas for officials assigned by competent authorities to review, consider transferring the number of public employees within the total number of 7,191 public employee quotas (including 5,066 quotas at local levels and 2,125 quotas at ministries and central authorities) currently working in official job positions of state management agencies, organizations to officials accordingly; thereafter determining the specific number of remaining public employee quotas needed to be converted into officials (including the number of public employees who meet and do not meet the standards, conditions for promotion into officials according to regulations) to sum up and advise the Party Committee of the Government of Vietnam.
- In order to solve the longstanding issues related to many agencies and organizations, the Ministry of Home Affairs will take the lead, coordinate with ministries and agencies to meticulously and strictly review, inspect, and evaluate the staff allocation and management work, the implementation of financial and income management mechanisms in state management agencies operating under special financial and income management mechanisms (before and after implementing the mechanism);
Thereafter propose the allocation of official quotas and suitable financial mechanisms for these agencies and organizations;
Ensure principles, policies, and regulations of the Communist Party and state laws; report to the Party Committee of the Government of Vietnam before submitting to the Politburo for consideration and decision.
- To take the lead, cooperate with the Ministry of Education and Training to review and evaluate the staffing of educational institutions during the period of 2022-2026 and propose solutions to address the surplus of teachers for the period 2024-2026 at local levels to report to the Party Committee of the Government of Vietnam for consideration and decision.
(2) Implementing the Conclusion of the Central Steering Committee on staff management, not resolving requests for additional staff for the period of 2022-2026 for the Ministry of Justice, the Ministry of Construction, and not implementing the reduction of 10% of the workforce at Vietnam Social Security for the period 2022-2026.
(3) Ministries, central authorities, and local authorities:
- Strictly implement the policies and regulations of the Communist Party regarding the restructuring of organizational apparatus to be streamlined, operate effectively and efficiently, streamline staffing linked to restructuring and improving the quality of the officials and public employees workforce;
- Direct the agencies and units under their management to promptly approve and promulgate the list of job positions for officials and public employees (for titles not included in the job position list, they should be determined according to Conclusion No. 35-KL/TW in 2022 of the Politburo on the list of titles, leading positions and equivalents in the political system from central to local levels);
- Continue to implement, complete the construction of job descriptions, competency frameworks for the job positions of officials and public employees within the agencies, and units under their management, ensuring compliance with the requirements of Resolution 28-NQ/TW in 2022.
What are the duties of officials in carrying out public duties in Vietnam?
Based on Article 9 of the Law on Cadres and Civil Servants 2008, the duties of officials in carrying out public duties in Vietnam are as follows:
(1) Perform correctly, fully, and be responsible for the results of the tasks and powers assigned.
(2) Have a sense of organizational discipline; strictly observe the regulations and procedures of the agency, organization, and unit; report to the competent person when detecting any acts in violation of the law within the agency, organization, and unit; protect state secrets.
(3) Proactively and closely coordinate in performing public duties; maintain solidarity within the agency, organization, and unit.
(4) Protect, manage, and use effectively and economically the state assets entrusted.
(5) Comply with decisions from superiors. When there are grounds to believe that the decision is illegal, must promptly report in writing to the decision-maker; if the decision-maker still insists on execution, there must be a written document, and the executor must comply but will not be held responsible for the consequences of the execution, and at the same time report to the direct superior of the decision-maker. The decision-maker must take responsibility before the law for their decision.
(6) Other duties as prescribed by law.
