What are the details of guidelines for surveying and collecting sample to assess soil contamination in Vietnam under Circular 11/2024/TT-BTNMT?

Guidance on surveying and collecting sample to assess soil contamination in Vietnam is stipulated in Article 28 of Circular 11/2024/TT-BTNMT.

The process of surveying and collecting sample to assess soil contamination in Vietnam is as follows:

(1) For regional-level pollution investigation and assessment

- Delineate and amend the boundaries of soil compartments according to factors affecting the soil from the amount of inorganic fertilizer, plant protection chemicals, feed, and chemicals used in aquaculture, or polluted irrigation water sources, and describe the investigation results in a prepared report in Clause 3, Article 27 of Circular 11/2024/TT-BTNMT;

- Identify soil sampling locations in the field, determining sampling coordinates using positioning devices; update and supplement the sampling locations on the field investigation map (if changes are made);

- Collect soil samples;

- Photograph landscapes of the investigation area and soil sampling points;

- Write soil sampling records;

- Pack and preserve soil samples;

- Review and update field investigation results from points a, b, c, d, and dd of Clause 1, Article 28 of Circular 11/2024/TT-BTNMT into the investigation data table created in Clause 2, Article 27 of Circular 11/2024/TT-BTNMT;

- Develop a report on field investigation and soil sampling results.

(2) For provincial-level pollution investigation and assessment

- Investigate and identify the direction of pollution spread; investigate and determine topographical and landscape factors that can block or hinder pollution spread; delineate and amend soil compartment boundaries according to pollution sources, pollutants, and describe the investigation results in a prepared report in Clause 3, Article 27 of Circular 11/2024/TT-BTNMT;

- Investigate, collect soil samples, and update field investigation results as stipulated in points b, c, d, dd, e, and g of Clause 1, Article 28 of Circular 11/2024/TT-BTNMT;

- Develop a report on field investigation and soil sampling results;

- Conduct the investigation of the contents specified in this clause only for areas without existing soil environmental pollution assessment and classification results as per environmental protection laws.

What are the regulations for subjects of land surveying, assessment and land conservation and restoration in Vietnam?

Based on Article 4 of Circular 11/2024/TT-BTNMT regulating the subjects of land surveying, assessment and land conservation and restoration in Vietnam:

(1) Subjects of investigation and evaluation of land quality, land degradation nationwide, economic-social regions (hereinafter referred to as regional level), provinces, and centrally-governed cities (hereinafter referred to as provincial level) include agricultural land and unused land (excluding rocky mountains without forest coverage).

(2) Subjects of investigation and evaluation of land potential nationwide, at the regional level, and at the provincial level include agricultural land, non-agricultural land, and unused land.

(3) Subjects of soil contamination investigation and evaluation

(i) Subjects of soil contamination investigation and evaluation nationwide and at the regional level include agricultural land and unused land (excluding rocky mountains without forest coverage);

(ii) Subjects of soil contamination investigation and evaluation at the provincial level are types of land with pollution sources, including agricultural land, unused land (excluding rocky mountains without forest coverage), and land planned for urban and rural residential construction.

(4) Subjects of soil quality monitoring, land degradation, and soil contamination include types of land specified in (1) and (3) identified according to the fixed monitoring network across the country.

(5) Subjects of thematic land investigation and evaluation include one or more types of land specified in Article 9 of the Land Law 2024 performed by state authorities with competence to organize thematic land investigation and evaluation determinations during task approval.

(6) Subjects of land protection, rehabilitation, and restoration include types of land in areas undergoing degradation or pollution.

How to construct soil contamination maps in Vietnam?

According to Article 30 of Circular 11/2024/TT-BTNMT, the construction of soil contamination maps in Vietnam is regulated as follows:

(1) Standardize the base factors of soil contamination maps according to regulations specified in (i2) and (iii2), points a and d of Clause 3, Article 6 of Circular 11/2024/TT-BTNMT.

(2) Create information layers and data attribute fields in each thematic information layer following the structure and type of information specified in Part D of Appendix IV issued together with Circular 11/2024/TT-BTNMT, including:

(i) Soil type information layer;

(ii) Pollution level classification information layer;

(iii) Delineated areas requiring treatment, rehabilitation, and restoration information layer.

(3) Construct soil type information layer

(i) Convert data format from land use status maps at the same level as the soil contamination assessment results maps;

(ii) Review and adjust soil compartment boundaries based on field investigation results;

(iii) Standardize and input soil type information as stipulated in Table 03/QDC of Appendix I issued together with Circular 11/2024/TT-BTNMT into the information layer specified in (i2);

(4) Review and amend soil compartment boundaries in the investigation area within the soil compartment information layer of the field investigation map as stipulated in Clause 1, Article 27 of Circular 11/2024/TT-BTNMT according to the aggregated information processing results specified in Clause 3, Article 29 of Circular 11/2024/TT-BTNMT.

(5) Construct soil contamination maps

(i) Build pollution level classification information layers according to the criteria stipulated in point a, Clause 3, Article 29 of Circular 11/2024/TT-BTNMT;

(ii) Export data to support the analysis and assessment of the status of contaminated land;

(iii) Compile and construct explanatory reports of soil contamination maps and print the soil contamination maps;

(iv) The procedure for building soil contamination maps is detailed in Diagram 02/OND of Appendix IV issued together with Circular 11/2024/TT-BTNMT.

(6) Delineate contaminated soil areas requiring treatment, rehabilitation, and restoration

(i) Identify contaminated soil areas from the pollution level classification results specified in (i5);

(ii) Transfer boundaries and input attribute information of areas requiring treatment, rehabilitation, and restoration into the information layer specified in (iii2).

(7) Construct soil contamination data

(i) Standardize data related to soil contamination as regulated by laws on the national land database;

(ii) Scan other related data.

(8) Update soil contamination data into the national land database as regulated by laws on the national land database.
