What are the criteria for consideration for awarding the "Advanced Laborer" title in the ethnic minority affairs sector in Vietnam?

Article 2 of Circular 01/2024/TT-UBDT stipulates as follows:

Criteria for consideration for awarding the "Advanced Laborer" title
1. The "Advanced Laborer" title shall be awarded annually to individuals of units under and affiliated to the Committee of Ethnic Minority Affairs meeting the standards specified in Clause 1, Article 24 of the Law on Emulation and Commendation in 2022.
2. For individuals who transfer jobs, the new unit is responsible for consideration for the "Advanced Laborer" title. In case of working time in the old unit for 06 months or more, comments from the old unit must be obtained. Suppose an individual is assigned or seconded to another agency, organization, or unit within a certain time. In that case, the consideration for the "Advanced Laborer" title shall be considered and decided by the old agency, organization, or unit and confirmed by the receiving agency, organization, or unit.
3. For individuals who are sent to participate in short-term training and retraining courses for less than 01 year and comply well with the regulations of training and retraining institutions, the learning time shall be included in the working time at the agency or unit to be considered for the "Advanced Laborer" title. For individuals who are sent to participate in training and retraining courses for at least 01 year, comply well with the regulations of training and retraining institutions, and have good learning results or higher (for training and retraining courses with average, good, and very good grades), they shall be considered for the "Advanced Laborer" title.
4. Maternity leave for individuals as prescribed shall be included in the required working time for consideration for the "Advanced Laborer" title.
5. The "Advanced Laborer" title shall not be considered in one of the following cases:
a) Having a new recruitment period of less than 06 months.
b) Take leave from work as prescribed by law in the year from 03 months to less than 06 months (except for the case specified in Clause 4 of this Article).
c) Individuals under considering disciplinary enforcement or investigating, inspecting, or examining when having signs of violations or complaints or denunciations to be verified and clarified.

Thus, individuals working in ethnic minority affairs agencies must complete tasks from good levels or above; have the spirit of self-reliance, unity, and mutual assistance, and actively participate in emulation movements to be considered for the "Advanced Laborer" title.

In 2024, what is the bonus applicable to the "Advanced Laborer" title in Vietnam?

Under the provisions of Article 54 of Decree 98/2023/ND-CP on bonuses applicable to emulation titles in 2024 as follows:

Bonuses
1. For individuals:
a) The "National Emulation Soldier" title: Certificate, frame, Badge, Badge box and a bonus 4.5 times the statutory pay rate;
b) The “Emulation Fighter of the Ministry, Department, and Central or Provincial Authority” title: Certificate, frame, Badge, Badge box and a bonus of 3.0 times the statutory pay rate;
c) The "Grassroots-Level Emulation Fighter" title: Certificate, frame and a bonus 1.0 times the statutory pay rate;
d) The “Advanced Laborer”, “Advanced Fighter” titles: 0.3 times the statutory pay rate.
2. For collectives:
a) The “Excellent Labor Collective”, and “Determined-to-Win Unit” titles: Certificate, frame and a bonus of 1.5 times the statutory pay rate;
b) The “Advanced Labor Collective”, and “Advanced Unit" titles: 0.8 times the statutory pay rate;
c) Typical commune, ward, or town: Certificate, frame and a bonus of 2.0 times the statutory pay rate;
d) The “Village or street quarter of culture” title: Certificate, frame and a bonus of 1.5 times the statutory pay rate;
d) The “Emulation Flag of the Government of Vietnam” title: Flag and a bonus of 12.0 times the statutory pay rate;
e) The “Emulation Flag of the Ministry, Department, and Central or Provincial Authority” title: Flag and a bonus of 8.0 times the statutory pay rate;
g) The “Emulation flags of military regions, corps, services, armies, general departments, and equivalences of the Ministry of National Defense of Vietnam and the Government Cipher Committee”; “emulation flags of the national universities” titles: Flag and a bonus of 6.0 times the statutory pay rate.

Thus, the bonus applicable to the "Advanced Laborer" title in Vietnam shall be based on the statutory pay rate.

The current statutory pay rate is 1,800,000 VND/month (According to Clause 2, Article 3 of Decree 24/2023/ND-CP).

Individuals awarded the "Advanced Laborer" title shall receive a bonus equal to 0.3 times the statutory pay rate, equivalent to 540,000 VND.

Collectives awarded the "Advanced Labor Collective" title shall receive a bonus equal to 0.3 times the statutory pay rate, equivalent to 1,440,000 VND.

However, from July 1, 2024, upon salary reform, the statutory pay rate will be eliminated. Therefore, there may be new guidance on bonuses shortly.

What are the forms of commendations in Vietnam?

Under the provisions of Article 9 of the Law on Emulation and Commendation 2022, forms of commendations in Vietnam include:

(1) Order.

(2) Medal.

(3) Honorary title of the state.

(4) “Giải thưởng Hồ Chí Minh” (Ho Chi Minh Prize), “Giải thưởng Nhà nước” (State Prize).

(5) Commemorative medal.

(6) Diploma of Merit.

(7) Certificate of Merit.
