What are the criteria for coaches participating in professional football leagues in Vietnam?

Pursuant to Article 30 of the Appendix to the Professional Football Regulations promulgated together with Decision 76/QD-TC TDTT in 2022 as follows:

- In terms of professional qualifications, coaches participating in professional football leagues must meet the minimum requirements for professional qualifications listed below or equivalent foreign coaching qualifications recognized by the Asian Football Confederation (AFC):

- National Football League:

- Vietnamese National Football First League

+ Participate in training courses recognized by the Vietnam Football Federation with a diploma according to the minimum requirements of each tournament; or

+ Have a certificate of competence and experience issued by AFC in accordance with the AFC Regulations on Certificate of Competence and Experience in case the coach does not meet the minimum qualification requirements of each tournament.

- Other conditions: The coach must have an employment contract and be registered by the club with the Vietnam Football Federation, the tournament organizer.

Can a professional football coach enter into employment contracts with two football teams in Vietnam?

Pursuant to Clause 1, Article 19 of the Labor Code 2019 as follows:

Entering into multiple employment contracts
1. An employee may enter into employment contracts with more than one employer, provided that he/she fully performs all terms and conditions contained in the concluded contracts.

Accordingly, there are currently no provisions restricting the right to enter into contracts with two or more units. However, employees should pay attention to ensure the performance of the signed employment contracts.

However, Article 31 of the Appendix to the Professional Football Regulations issued together with Decision 76/QD-TC TDTT in 2022 stipulates the employment contract of coaches as follows:

Coach's employment contract
1. The coach must enter into an employment contract with the club in accordance with the provisions of the labor law and in accordance with the provisions of FIFA, the AFC and this Regulation.
2. The contract shall include at least 03 (three) original copies, 01 (one) copy kept at the club, 01 (one) copy kept by the coach and 01 (one) copy registered at the Vietnam Football Federation.
3. The employment contract must stipulate that the coach is obliged to comply with the current regulations of the club: Rules, regulations, collective labor agreements (if any) and the club must notify or provide the coach with these regulations when signing the employment contract with the coach.
4. The terms of the contract that allow the club more time to pay salaries to the coach will not be recognized, except as stated in the collective labor agreement.
5. Coaches may not simultaneously enter into employment contracts with multiple clubs to coach teams with opposing interests.
6. Disciplinary action against coaches must not contravene the provisions of the labor law. If the application of discipline is not correct, the club is responsible for canceling the practice of discipline, publicly apologizing to the coach in front of the whole team, restoring the honor and material rights to the coach as before he was not disciplined.
7. If the coach is suspended or banned from duty according to the disciplinary decision of the Vietnam Football Federation, the club is responsible for enforcing this disciplinary measure against the coach.

Currently, professional coaches are not allowed to enter into employment contracts with many clubs including opposing interests. They are only allowed to enter into contracts with teams including similar interests. For example, a coach can be responsible for the men's team of Hanoi and the women's team of Quang Ninh province.

What are the regulations on participating in the Vietnam National Team of professional football coaches?

Pursuant to Clause 3, Article 6 of the Appendix to the Professional Football Regulations issued together with Decision 76/QD-TCTDTT in 2022 stipulating the obligation to join the national team of coaches as follows:

- The coach is responsible for participating at the request of the Vietnam Football Federation after being agreed by the host club. In case the coach cannot participate due to force majeure or good reasons, he/she must report to the Vietnam Football Federation and be approved by the Vietnam Football Federation.

- After the end of the concentration period, the coach returns to duty for the registered club. The return period shall not exceed 24 hours from the end of the concentration period. The above period may be longer in exceptional cases and cases with good reason.

- The coach shall receive the benefits agreed in the contract with the club during the concentration period, the benefits according to the relevant regulations of the state and the Vietnam Football Federation.

- The coach who violate discipline in activities, performing duties with effects to the honor and reputation of the Team during the concentration period will be disciplined according to regulations.
