What are the conditions for enterprises to be granted licenses to operate services to send Vietnamese workers to work abroad under contracts?
Pursuant to Article 10 of the Law on Vietnamese employees working abroad under contracts in 2020, the conditions for enterprises to be granted licenses for service activities to send Vietnamese workers to work abroad under the contract are:
- An enterprise shall be issued with license for provision of Vietnamese guest worker service if the enterprise:
+ has at least VND 5 billion of charter capital; has owners, members and shareholders who are domestic investors according to Law on Investment; and
+ has made deposit payments according to Article 24 of this Law; and
+ has Vietnamese nationals as legal representatives with at least higher education level and at least 5 years of experience in providing Vietnamese guest worker service or employment services; is not criminally prosecuted; has no criminal records regarding violation to national security, charges that violate life, health, self-esteem or dignity of human beings, fraudulence for appropriation, credibility abuse for appropriation, false advertisement, manipulating customers, organizing or allowing other individuals to migrate or stay in Vietnam illegally, organizing or allowing other individuals to travel abroad or stay abroad illegally, forcing other individuals to travel abroad or stay abroad illegally;
+ has adequate number of professional employees to implement provisions of Article 9 of this Law;
+ has adequate facilities of enterprises or is continuously hired by enterprises to satisfy orientation education for Vietnamese guest workers;
+ has a web page.

Pursuant to Article 12 of Decree 112/2021/ND-CP stipulating conditions for operating services to send Vietnamese workers to work in Taiwan are prescribed as follows:
- Service enterprises must maintain the conditions for being granted a license to operate services to send Vietnamese workers to work abroad under contracts
- Have a sufficient number of professional staff to carry out the content of activities and meet the following standards:
+ There is at least 01 professional staff carrying out activities to search and develop the foreign labor market with Chinese language proficiency at least HSK5 or equivalent;
+ Have at least 01 professional staff performing labor management activities with Chinese language proficiency at least HSK5 or equivalent and at least 01 year of experience in sending Vietnamese workers to work in Taiwan (China);
+ There is at least 01 professional staff performing orientation education activities with at least 01 year of experience in sending Vietnamese workers to work in Taiwan (China).
- Not be sanctioned for violating the law in the field of Vietnamese employees working abroad under contracts within 02 years from the date of request to the Ministry of Labor, War Invalids and Social Affairs of Vietnam to introduce to the competent authorities of Taiwan (China).
What are dossiers and procedures for registration of service activities for sending Vietnamese workers to work in Taiwan?
Pursuant to Article 13 of Decree 112/2021/ND-CP stipulating that dossiers and procedures for registration of service activities for sending Vietnamese workers to work in Taiwan are prescribed as follows:
Dossiers of registration of service activities to send Vietnamese workers to work in Taiwan include:
- Written request according to Form No. 07 of Appendix I issued together with Decree No. 112/2021/ND-CP
- 01 copy of foreign language diplomas and certificates
-01 copy of documents proving working experience (labor contract, labor contract termination document or process of participating in social insurance or certificate of experience of the place of work) of professional staff specified in Clause 1 Article 12 of Decree 112/2021/ND-CP
- Procedures for registration of service activities to send Vietnamese workers to work in Taiwan are prescribed as follows:
+ Service enterprises submit 01 dossier directly or via postal service to the Ministry of Labor, War Invalids and Social Affairs of Vietnam or online at the Portal (www.dolab.gov.vn);
+ Within 05 working days from the date of receipt of a complete dossier as prescribed, the Ministry of Labor, War Invalids and Social Affairs of Vietnam shall issue a written introduction of the service enterprise to the competent authority of Taiwan.
In case of non-introduction, the Ministry of Labor, War Invalids and Social Affairs of Vietnam shall respond in writing and clearly state the reasons.
