According to the provisions of Article 20 of Decree 121/2021/ND-CP, the business eligibility certificates for prize-winning video game business will be granted when satisfying the following conditions:
- Enterprises shall only be considered for granting business eligibility certificates for the prize-winning video game business when registering to trade in the prize-winning video game industry in accordance with the Investment Law and the Enterprise Law and fully satisfy the conditions specified in Clause 3 of this Article.
- The enterprises specified in Clause 1 of this Article must apply for a Certificate of Business Eligibility before organizing the business of prize-winning electronic games.
- Conditions for granting the business eligibility certificates for business, including:
+ Enterprises with tourist accommodation establishments that have been rated 5 stars by competent state management agencies according to the provisions of the Law on Tourism and guiding documents;
+ Have an area to arrange a business point that fully meets the conditions specified in Article 5 of this Decree;
+ Have a manager and operator of a business location that meets the conditions and criteria specified in Clause 1, Article 19 of this Decree;
+ Have a minimum charter capital of VND 500 billion and the fiscal year immediately preceding the year the enterprise submits the application for the Certificate of eligibility for business, and the enterprise is profitable;
+ Havie a business plan for prize-winning electronic games to ensure the maintenance of social security, order and safety in accordance with law.
- Each tourist accommodation establishment may only consider and grant one Certificate of Business Eligibility and the Certificate of Business Eligibility shall only be granted to the enterprise owning tourist accommodation establishment.
Thus, according to the provisions of Article 20 of Decree 121/2021/ND-CP, when satisfying the above conditions, the business eligibility certificates for prize-winning video game business will be granted.
What are the regulation on dossier of application for a business eligibility certificates for prize-winning video game business?
A dossier of application for business eligibility certificates for prize-winning video game business under Article 21 of Decree 121/2021/ND-CP includes:
- An application form for the business eligibility certificates for business, made according to Form No. 01 specified in Appendix II issued with this Decree.
- A copy of the Investment Registration Certificate or the Enterprise Registration Certificate issued by a competent state management agency in accordance with the Law on Investment, the Law on Enterprises, including the sector business registration, prize-winning video game.
- A copy of the decision on rating the tourist accommodation establishment issued by a competent state management agency and documents proving that the enterprise is in the name of the tourist accommodation establishment.
- Documents proving the number of accommodation rooms that have been put into business at the tourist accommodation establishment.
- Layout diagram of the Business location, in which the following basic contents are explained: the entrance and exit of the Business location; the area where prize-winning video game machines are located; cashier area, treasury for counting cash and conventional currency and storing equipment for storing cash and conventional currency; the area to arrange electronic equipment and camera system for monitoring, monitoring and fire prevention and fighting equipment.
- The financial statement of the year preceding the year the enterprise submits the application for the business eligibility certificates audited by an independent audit organization for units with public interests. - Business plan, including the following main contents: objectives, quantity, types and types of prize-winning electronic games, expected demand for foreign currency revenue and expenditure, solutions to ensure security and order Safety, social safety for Business location and implementation plan.
- A list, brief curriculum vitae of qualifications and working experience, copies of diplomas notarized by competent state management agencies or copies enclosed with the presentation of the originals for comparison and proof of competence. professional qualifications and skills of the manager and operator of the Business location.
What are the regulation on procedure for granting the business eligibility certificates for the prize-winning video game business?
According to Article 22 of Decree 121/2021/ND-CP, the procedures for granting the business eligibility certificates for the prize-winning video game business are as follows:
- Enterprises shall submit 01 application for the business eligibility certificates to the Ministry of Finance in one of the following forms:
+ Submit directly to the Ministry of Finance;
+ Through post offices;
+ Through the public service portal of the Ministry of Finance.
Within 15 days from the date of receipt of the dossier, the Ministry of Finance shall notify the completeness and validity of the dossier and request the enterprise to supplement documents (if any) and send 06 sets of official dossiers for appraisal according to the form specified at Points a and b of this Clause.
- Within 60 days from the date of receipt of all 06 official dossiers, the Ministry of Finance shall consider and grant the Certificate of eligibility for business. In case of refusal to issue a Certificate of eligibility for business, the Ministry of Finance shall notify in writing the enterprise and clearly state the reasons for the refusal.
- Procedures for application assessment:
+ Within 15 days from the date of receipt of valid dossiers, the Ministry of Finance shall send the dossiers for opinions to relevant agencies, including: the Ministry of Public Security, the Ministry of Culture, Sports and Tourism, and the Ministry of Planning and Investment, the State Bank of Vietnam and the People's Committees of the provinces and cities under central direct management (hereinafter referred to as the Provincial People's Committees) where the enterprises apply for permission to organize prize-winning video game business;
+ Within 15 days from the date of receipt of complete dossiers for opinion collection, the agencies receiving opinions must send their opinions in writing to the Ministry of Finance and take responsibility for the opinions collected;
+ After receiving all opinions from relevant agencies, the Ministry of Finance shall summarize the opinions; coordinate with the Ministry of Public Security, the Ministry of Culture, Sports and Tourism, the People's Committee of the province and relevant agencies to organize an inspection at the tourist accommodation establishment to determine the area where the business point will be located. satisfy the conditions specified at Point a, Clause 2, Article 5 of this Decree; determine the number of accommodation rooms that have been put into business as a basis for determining the maximum number of prize-winning video game machines the enterprise is allowed to operate in accordance with the provisions of Clause 1, Article 7 of this Decree and consider and decide the issuance or non-issuance of the Certificate of eligibility for business;
+ After being granted a business eligibility certificate for business by the Ministry of Finance, the enterprise is responsible for carrying out procedures for adjusting and supplementing the prize-winning electronic game business lines in the Certificate of satisfaction of security conditions. security and order as prescribed by law before organizing prize-winning video game business.
- Contents of appraisal: Pursuant to the provisions of this Decree and other relevant laws, the Ministry of Finance and relevant agencies shall appraise the dossier according to the contents in accordance with the provisions of this Decree. conditions specified in Article 20 of this Decree.
