What are the cases of being fined when wearing helmets in Vietnam?

Pursuant to the provisions of Article 8 of the Joint Circular No. 06/2013/TTLT-BKHCN-BCT-BCA-BGTVT, the provisions are as follows:

Responsibility of bikers
Bikers shall:
1. Wear helmets as prescribed by law.
2. Fasten the straps as follows:
a) Keep the straps to the sides, put on the helmet, and fasten the straps. Straps must be tighten to fit the chin;
b) After the helmet to put on, use a hand to pull it from behind to front or raise the part at the forehead (or the chin – for full-face helmets) then pull it back to check whether the helmet is removed from the head.

Accordingly, the criteria for properly fastening straps are explained in detail:

- Keep the straps to the sides, put on the helmet, and fasten the straps. Straps must be tighten to fit the chin;

What are 03 cases of not wearing a helmet in Vietnam?

Pursuant to the provisions of Point b, Clause 4, Article 2 of Decree 123/2021/ND-CP, 03 exceptions are not sanctioned if the passengers do not wear helmets, which are:

- a patient who needs urgent medical care,

- a child under 06 years of age,

- or a criminal being escorted.

Thus, in all cases, the driver (the person in the front seat) must wear a helmet and properly fasten the straps. Meanwhile, the person sitting in the back may not wear a helmet if they fall into one of the three cases mentioned above.

Vietnam: What is the penalty for failure to wear a motorcycle helmet properly?

Pursuant to Clause 3, Article 6 of Decree 100/2019/ND-CP (amended and supplemented by Point b, Clause 4, Article 2 of Decree 123/2021/ND-CP) stipulates as follows:

Penalties imposed upon operators of mopeds and motorcycles (including electric motorcycles) and the like violating road traffic rules

3. A fine ranging from VND 400,000 to VND 600,000 shall be imposed upon a vehicle operator who commits any of the following violations:
a) Turning without slowing down or signaling (unless going along a curved segment where there is no level crossing);
b) Carrying 03 people or more on the vehicle;
c) Continuously honking, revving the engine in urban areas or residential areas, except for the emergency vehicles on duty;
...
n) Failure to wear a motorcycle helmet properly or wearing it improperly;
o) Carrying a person who does not wear a motorcycle helmet or does not wear the motorcycle helmet properly, unless that person is a patient who needs urgent medical care, a child under 06 years of age, or a criminal being escorted.

Thus, according to the above regulations, motorcyclists who do not wear helmets and do not properly fasten the straps will be fined from 400,000 VND to 600,000 VND.
