What are the aggravating factors for disciplinary actions against party organizations in Vietnam?
In addition to mitigating factors, Article 6 of Regulation 69/QD-TW dated 2022 issued by the CPV Central Committee stipulates the aggravating factors as follows:
Aggravating factors for disciplinary actions
In cases where violations involve one or several of the following factors, disciplinary actions must be considered for aggravating:
1. For party organizations:
a) Failing to promptly rectify and correct shortcomings, violations according to the conclusions of the party organization or competent authority; not voluntarily admitting shortcomings and violations.
b) Repressing those who fight, denounce, testify, or provide evidence of violations; obstructing, preventing, or causing difficulties during the process of investigation, verification, and evidence collection; concealing violations.
c) Providing false information and reports; threatening, coercing others not to provide evidence or documents; not providing or inadequately providing, destroying relevant documents and evidence related to violations; forging records, documents, and evidence to evade consequences.
d) Exploiting emergency situations, natural disasters, fires, epidemics, social security policies, and national defense and security to gain personal benefit.
dd) Committing violations more than once, systematically, or continuing to violate after being disciplined; deliberately delaying the consideration and resolution of issues, worsening the situation in organizations and units.
e) Knowing but not preventing or allowing corruption and negative acts by officials and communist party members directly under their management, causing serious consequences.
2. For communist party members:
a) Failing to comply with the requests of the party organization for self-criticism, not rectifying deficiencies and violations. Not voluntarily admitting shortcomings and violations; causing material damage but not compensating, or not compensating as required by the competent authority.
b) Obstructing, evading, impeding the process of inspection, supervision, audit, investigation, prosecution, trial, or enforcement; covering up for violators; threatening, repressing, retaliating against those who fight, denounce, testify, and provide documents and evidence of violations.
c) Violating in an organized manner, acting as the ringleader; providing false information and reports; obstructing others from providing evidence of violations; concealing, modifying, destroying evidence, creating forged records, documents, and evidence.
d) Abusing positions and powers, taking advantage of emergency situations, natural disasters, fires, epidemics to exploit social security policies, and national defense and security for personal benefit. Compelling, mobilizing, organizing, facilitating others to commit violations.
Thus, the aggravating factors for disciplinary actions against party organizations in Vietnam include:
- Failing to promptly rectify and correct shortcomings, violations according to the conclusions of the party organization or competent authority; not voluntarily admitting shortcomings and violations.
- Repressing those who fight, denounce, testify, or provide evidence of violations; obstructing, preventing, or causing difficulties during the process of investigation, verification, and evidence collection; concealing violations.

Mitigating factors for disciplinary actions
In cases where violations involve one or several of the following factors, disciplinary actions may be considered and mitigated:
1. For party organizations:
a) Proactively and promptly reporting violations to higher-level party organizations, demonstrating a serious attitude in self-criticism, voluntarily admitting shortcomings and violations, and accepting corresponding disciplinary actions.
b) Proactively providing full and honest information, documents, and evidence reflecting the violations.
c) Proactively ceasing the violation and fundamentally and promptly remedying the consequences caused by the violation before and during the inspection and supervision process.
d) Assisting the competent party organization to accurately and promptly inspect, consider, and handle violating organizations and individuals.
2. For communist party members:
a) Proactively reporting one's own violations to the party organization, voluntarily taking individual responsibility for shortcomings and violations, and accepting corresponding disciplinary actions before and during the inspection and supervision process.
b) Proactively providing full and honest information, records, and documents reflecting on those who together committed violations.
c) Proactively ceasing the violation, actively participating in preventing the violation; voluntarily handing over corrupt assets, compensating for damages, and remedying the consequences caused by oneself.
d) Violations committed while implementing policies or piloting innovative, creative measures as allowed by the competent authority under the regulations, not falling within the provisions of Point đ, Clause 14, Article 2 of this Regulation.
According to the above regulations, the mitigating factors for disciplinary actions against party organizations in Vietnam are as follows:
- Proactively and promptly reporting violations to higher-level party organizations, demonstrating a serious attitude in self-criticism, voluntarily admitting shortcomings and violations, and accepting corresponding disciplinary actions.
- Proactively providing full and honest information, documents, and evidence reflecting the violations.
- Proactively ceasing the violation and fundamentally and promptly remedying the consequences caused by the violation before and during the inspection and supervision process.
- Assisting the competent party organization to accurately and promptly inspect, consider, and handle violating organizations and individuals.
What are the disciplinary measures taken against party organizations in Vietnam?
Under Article 7 of Regulation 69/QD-TW dated 2022 issued by the CPV Central Committee:
Disciplinary measures
1. For party organizations: Reprimand, warning, disbandment.
2. For official communist party members: Reprimand, warning, dismissal (if holding a position), expulsion.
3. For probationary communist party members: Reprimand, warning.
Thus, violating party organizations will be subject to three Disciplinary measures: reprimand, warning, and disbandment.
