Based on Article 51 Law on Social Insurance 2024, the leave period for prenatal checks-up is regulated as follows:

Based on Clause 3, Article 61 Law on Social Insurance 2024, the documents required for maternity benefits are regulated as follows:

3. The dossier for maternity benefits for female employees who undergo prenatal examinations as regulated in Article 51 of this Law; female employees who miscarry, undergo an abortion, or have a stillbirth, or ectopic pregnancy as regulated in Article 52 of this Law; employees who undergo contraceptive measures as stipulated in Article 57 of this Law shall include one of the following documents:

a) The original or a copy of the hospital discharge certificate or a summary of the medical record or documents proving the inpatient treatment process of the employee in case of inpatient treatment;

b) The certificate of leave for social insurance in case of outpatient treatment;

c) The original or a copy of the hospital discharge certificate showing the indication for outpatient treatment duration post inpatient treatment.

4. The dossier for maternity benefits for employees who adopt children under 06 months old includes a copy of the child adoption certificate and the transfer record.

The dossier for maternity benefits for female employees undergoing prenatal examinations includes one of the following documents:

(1) The original or a copy of the hospital discharge certificate or a summary of the medical record or documents proving the inpatient treatment process of the employee in case of inpatient treatment;

(2) The certificate of leave for social insurance in case of outpatient treatment;

(3) The original or a copy of the hospital discharge certificate showing the indication for outpatient treatment duration post inpatient treatment.

* Note:

- In case these documents or similar documents issued by competent foreign agencies, organizations, or individuals must meet the following requirements:

+ Have a notarized or certified Vietnamese translation according to the law on notarization and certification;

+ Be legalized, except where otherwise provided by international treaties to which the Socialist Republic of Vietnam is a member.

How will maternity benefits be settled for compulsory health insurance participants in Vietnam?

Based on Article 62 Law on Social Insurance 2024 regulating the resolution of maternity benefits for health insurance participants:

- Employees are responsible for submitting the dossier as stipulated in Article 61 of the Law on Social Insurance 2024 to the employer. The submission deadline is no later than 45 days from the end of the maternity benefits period.

Within 07 working days from the receipt of the complete dossier from the employee, the employer is responsible for compiling the list of employees on maternity benefits and submitting it along with the dossier prescribed in Article 61 of the Law on Social Insurance 2024 to the social insurance agency.

- Employees submit the dossier specified in Article 61 of the Law on Social Insurance 2024 directly to the social insurance agency in case of resigning before childbirth, receiving a child through surrogacy, adopting a child under 06 months old, or if there is no longer an employer.

- The social insurance agency must resolve the case within 07 working days from the receipt of the complete dossier from the employer, or within 05 working days from the receipt of the complete dossier from the employee; if not resolved, a written response must be provided with clear reasons.

The Law on Social Insurance 2024 takes effect in Vietnam from July 1, 2025.
