On March 28, 2022, the Ministry of Labor, War Invalids and Social Affairs of Vietnam issued Decision 257/QD-LDTBXH 2022 of the Ministry of Labor, War Invalids and Social Affairs on announcing of newly issued administrative procedures under the scope of the one on the implementation of the policy of supporting rent for employees. In which employees who want to get supported rentof 1,000,000 VND/month after returning to the labor market need the below procedures:

What are the requirements and conditions for employees to get supported of 1,000,000 VND/month in Vietnam?

The employee is supported to rent when fully meeting the following requirements and conditions:

(1) Working in an enterprise, cooperative, or business household with business registration in an industrial park, export processing zone or key economic area, specifically as follows:

- Industrial parks and export processing zones are established under the conditions, order and procedures specified in Decree 82/2018/ND-CP dated May 22, 2018 of the Government on management of industrial parks and economic sector.

- Key economic areas include:

+ Economic zones are established under the conditions, order and procedures specified in Decree 82/2018/ND-CP dated May 22, 2018 of the Government on management of industrial parks and economic zones.

+ 24 provinces and centrally-run cities in 04 key economic regions are planned and established under the Prime Minister's Decision (including provinces and cities: Hanoi, Hai Phong, Quang Ninh, Hai Duong). , Hung Yen, Vinh Phuc, Bac Ninh, Thua Thien Hue, Da Nang, Quang Nam, Quang Ngai, Binh Dinh, Ho Chi Minh City, Binh Phuoc, Tay Ninh, Binh Duong, Dong Nai, Ba Ria - Vung Tau, Long An, Tien Giang, Can Tho, Ca Mau, An Giang and Kien Giang).

(2) Having an employment relationship, currently renting or staying in a boarding house, specifically as follows:

- Renting, lodging in the period from April 1, 2022 to June 30, 2022.

- Having an indefinite-term labor contract or a definite-term labor contract of 01 month or more entered into and performed during the period from April 1, 2022 to June 30, 2022; except for the labor contract entered into in the continuation of the labor contract signed and performed previously.

- Being participating in compulsory social insurance (named on the list of participating in compulsory social insurance of the social insurance agency) in the month immediately preceding the time the employer prepares the list of proposed employees to be supported rent.

In case employees are not subject to compulsory social insurance as prescribed in Clause 4, Article 2 of Decree 115/2015/ND-CP dated November 11, 2015 of the Government detailing a number of articles of the Law on Social Insurance on compulsory social insurance, newly recruited employees who have entered into labor contracts but are not yet on the list of participating in compulsory social insurance of the social insurance agency must be on the employer's payroll list of the month preceding the time the employer makes a list of employees requesting rent support.

What documents are necessary to be supported rent of 1,000,000 VND/month for employees in Vietnam?

Application composition

- For employees:

An application form made according to Form No. 01 in the Appendix issued with Decision 08/2022/QD-TTg .

- For employers:

+ List of employees requesting rent support certified by the social insurance agency according to Form No. 03 in the Appendix issued together with Decision 08/2022/QD-TTg.

+ In case there are employees on the list who are not subject to compulsory social insurance participation, newly recruited employees and have entered into labor contracts but are not yet on the list of participating in social insurance.

If required by the social insurance agency, the dossier of request for support needs to include a copy of the salary list of the month preceding the time the employer makes a list of employees requesting rent support.

Number of dossiers: 01 (one) set.

What order are for employees to get supported rent of 1,000,000 VND/month In Vietnam?

Step 1. The employee requests for rent support according to Form No. 01 in the Appendix issued with Decision 08/2022/QD-TTg to send to the employer to summarize (the employee is responsible for the payment). accuracy of information as prescribed in Clause 1, Article 8 of Decision No. 08/2022/QD-TTg).

Step 2. The employer compiles a list of employees requesting rent support according to Form No. 03 in the Appendix issued together with Decision 08/2022/QD-TTg and publicly posts it at the workplace at least 3 working days. In case there are comments about the objects and conditions of support, the employer will verify the right objects and support conditions as prescribed within 02 working days.

Before the 15th of each month, the employer shall send the list of employees who request the rent support according to Form No. 03 in the Appendix issued together with Decision 08/2022/QD-TTg to the social insurance agency to confirm that employees are participating in compulsory social insurance.

Step 3. Within 02 working days from the date of receiving the request, the social insurance agency shall certify the employee's participation in compulsory social insurance.

Step 4. The employer sends the prescribed dossier to the district-level People's Committee where the head office or branch, representative office, production and business location is located. The deadline for receiving applications is until the end of August 15, 2022.

In case the employer is a business household, attach the request for housing rent support of the employee using Form No. 01 in the Appendix issued together with Decision 08/2022/QD-TTg.

Step 5. Within 02 working days from the date of receipt of the complete dossier, the People's Committee of the district shall appraise it and submit it to the People's Committee of the province.

Step 6. Within 02 working days from the day on which the complete application is received, the People's Committee of the province shall issue a decision approving the list and funding for support; at the same time directing the implementation of support payments.

In case of disapproval, the People's Committee of the province shall notify in writing and clearly state the reason.

Step 7. Within 02 working days, from the date of receipt of funding from the provincial People's Committee, the employer shall pay the employee.

The employer does one of the following formalities:

- Direct submission;

- Through the public postal service;

- Submit online.

- 09 working days from the date of receiving the application and dossier as prescribed.

- 11 working days from the date of receipt of the application and dossier as prescribed in case the employer has to conduct verification.
