Pursuant to Clause 1 and Clause 2, Article 3 of Decree 204/2004/ND-CP on the salary regime for officials and public employees and the armed forces:

1. Principles for salary arrangement and leadership position allowance
a) Officials and public employees appointed to any grade of officials and public employees (hereinafter referred to as grade) or to any professional or vocational title within the Court sector or the Procuracy sector (hereinafter referred to as title) shall be classified according to that grade or title.
b) Officials holding positions elected to professional and vocational wage classification and receiving leadership position allowances shall be classified according to the administrative official rank and receive leadership position allowances for the currently elected position.
c) Officials and public employees holding any leadership position (elected, appointed) shall be classified according to the leadership position salary or receive the leadership position allowance according to that position. If a person holds multiple leadership positions, they shall be classified according to the highest leadership position salary or receive the highest leadership position allowance. If concurrently holding the top leadership position of another agency or unit where a specialized staffing is arranged, they shall receive an additional concurrent position allowance.
d) Subjects within the armed forces and cryptographic sector shall be classified according to the respective wage schedule.
dd) Transition from old salary to new salary must be associated with reviewing and rearranging the staff of agencies and units; reviewing and completing the standards for officials and public employees; re-evaluating the old salary arrangement, and any cases particularly classified by an authorized agency in an unsatisfactory manner will be reassigned salary and position allowances accordingly.
2. Principles for salary payment
Salary payment must be associated with the performance results of officials and public employees and the source of salary payment (from the state budget allocation or assistance and from lawful revenue sources used for salary payment) of the agency or unit.
Thus, the principles for salary arrangement and leadership position allowance are as follows:
- Officials and public employees appointed to any grade of officials and public employees (hereinafter referred to as grade) or to any professional or vocational title within the Court sector or the Procuracy sector (hereinafter referred to as title) shall be classified according to that grade or title.
- Officials holding positions elected to professional and vocational wage classification and receiving leadership position allowances shall be classified according to the administrative official rank and receive leadership position allowances for the currently elected position.
