What are payment methods of union fees for union members in Vietnam?

Pursuant to Clause 1, Article 24 of the Regulation attached to Decision 1908/QD-TLD of 2016, regulations on methods of payment and management of union fees are as follows:

1. Methods of paying union fees

a) Union fees are paid directly monthly by members to the union team, sub-department union, member grassroots union, grassroots union, or sectoral union (according to the division of the grassroots union or sectoral union).

b) Union fees are collected through monthly salary (cash or bank transfer) after the member's consent. In this case, union fees collected must be confirmed by the unit's accounting department and include a detailed list of union members paying the fee.

c) Encourage union members and grassroots unions to innovate the method of collection and payment of union fees through modern technology (collection through personal accounts, ATM cards, etc.) based on a consensus between members and the grassroots union, with the direct approval of the upper-level union in writing.

2. Management of union fees:

Grassroots unions and sectoral unions tasked with collecting union fees from members must record, reflect, and promptly track the payment of union fees monthly according to the unit's membership list; safeguard and archive the collection records according to the accounting laws; aggregate and report financial income and expenditure reconciliation to the upper-level union. The distribution, usage, and management of union fees shall be executed according to the regulations of the General Confederation.

Thus, union members can pay union fees through the following methods:

- Members pay directly monthly to the union team, sub-department union, member grassroots union, grassroots union, or sectoral union (according to the division of the grassroots union or sectoral union).

6. Union members receiving Social Insurance benefits for one month or more, during which they are not required to pay union fees; union members who are unemployed, without income, or on unpaid leave for one month or more are not required to pay union fees during that period.

Union members who are unemployed are exempt from paying union fees during their unemployment period.

When shall union members temporarily suspend union activities and union fee payments in Vietnam?

According to Point h, Clause 1, Article 2 of Decision 174/QD-TLD of 2020 the provisions are as follows:

a. To participate in the establishment of grassroots unions, sectoral unions, and union activities in accordance with the Charter of the Vietnam General Confederation of Labor.

b. To request the union to represent and protect lawful and legitimate interests when infringed upon.

c. To obtain information, discuss, propose, and vote on union matters; to nominate, be nominated, and be elected to leadership bodies of the union; to question union officials; to propose disciplinary enforcement against erring union officials. Exemplary union members are introduced to the Communist Party for consideration of membership.

d. To receive guidelines and policies of the Communist Party, laws and regulations of the State related to unions and workers; to propose the union to recommend that employers implement policies in accordance with the law.

dd. To receive guidance, legal advice, and free legal assistance on labor laws, and union regulations; to have the union represent them in labor disputes to protect their lawful and legitimate rights and interests as prescribed by law.

e. To be visited and supported by the union when sick, in difficulty, or in distress; to participate in cultural, sports, entertainment, and tourism activities organized by the union; exemplary union members are given priority for admission to union-organized schools and classes; to receive support from the union in job finding and vocational training.

g. To be issued a union membership card and enjoy preferential treatment when using services provided by union establishments, and other forms of union cooperation.

h. Members who lose their jobs can temporarily suspend union activities and union fee payments, but not exceeding 12 months from the date of job loss.

i. To be exempt from union activities when retiring, and to be supported by the grassroots union where they complete retirement procedures and local union where they reside in case of difficulties; to participate in the retirement club, liaison committee supported by the union.

In cases where members lose their jobs, they are allowed to temporarily suspend union activities and union fee payments, but not exceeding 12 months from the date of job loss.
