List of establishments under fire prevention and fighting management in Vietnam from May 15, 2024
Pursuant to Appendix I attached to Decree 50/2024/ND-CP dated May 10, 2024, of the Government of Vietnam, the list of establishments under fire prevention and fighting management in Vietnam is as follows:
Below is the list of establishments under fire prevention and fighting management in Vietnam:
(1) Head offices of state agencies at all levels.
(2) Apartment buildings; collective housing, dormitories; mixed-use buildings.
(3) Nursery schools, kindergartens, preschools; primary schools, secondary schools, high schools; general education schools of multiple levels; colleges, universities, academies; secondary vocational schools; vocational training institutions; continuing education institutions; other educational establishments established under the Education Law.
(4) Hospitals; polyclinics, specialized clinics, nursing homes, rehabilitation, orthopedics, elderly care homes, epidemic prevention and control centers, medical centers, other medical establishments established under the Law on Medical Examination and Treatment.
(5) Theaters, cinemas, circuses; conference and event organization centers; cultural houses; Karaoke, dance hall, bar, and club service businesses; amusement parks, zoos, aquariums.
(6) Markets; commercial centers, electronics centers; supermarkets; service and food business establishments with a total business area of 100 m² or more or a total volume of 500 m³ or more; flammable and explosive goods business establishments with a total business area of 50 m² or more or a total volume of 200 m³ or more.
(7) Hotels, guesthouses, motels; other accommodation establishments established under the Tourism Law; hostels.
(8) Buildings used as corporate and organization offices, political organizations, and social organizations.
(9) Museums, libraries; exhibition centers; display houses, archives, bookstores, fair houses; religious establishments.
(10) Postal service buildings, postal processing centers, telecommunications establishments; data storage and management centers; broadcasting and television establishments; publishing and printing establishments.
(11) Stadiums; sports arenas; indoor sports centers; fitness and sports centers; racetracks, shooting ranges; other sports establishments established under the Law on Physical Training and Sports.
(12) Airports; air traffic control towers; aircraft hangars; sea ports; inland container depots; inland waterway ports; passenger bus stations; rest stops; railway stations; cable car stations; metro buildings; motor vehicle inspection centers; motor vehicle business, repair, and maintenance establishments.
(13) Automobile garages, parking lots established according to legal regulations.
(14) Road tunnels, railway tunnels with a length of 500 m or more.
(15) Nuclear facilities; establishments producing, trading, storing, and using industrial explosives and explosive precursors; industrial explosive warehouses, explosive precursor warehouses; industrial explosive import-export ports, precursor warehouse; arms and weaponry storage.
(16) Establishments exploiting, processing, producing, transporting, trading, and storing petroleum and petroleum products, gas on land; petroleum and gas warehouses; petroleum and gas import-export ports; petrol stations, flammable liquid stations; gas trading establishments.
(17) Industrial establishments with fire and explosion hazard grades A, B, C, D, E.
(18) Power plants; transformer stations with a voltage of 110 kV or more.
(19) Tunnels engaged in production, storage, and use of flammable and explosive substances; national reserve storage; warehouses for flammable goods and materials; flammable goods, materials, scrap storage yards with an area of 500 m² or more.
(20) Other establishments not listed from items 1 to 19 with internal petrol stations or central gas supply systems with a total gas use of 70 kg or more.
(21) Residential buildings combined with production and trading of flammable and explosive goods with a floor area for production and trading of 50 m² or more.

Authority to issue suspension decisions for establishments not ensuring fire safety in Vietnam
Pursuant to clause 8, Article 17 of Decree 136/2020/ND-CP as amended by clause 9, Article 1 of Decree 50/2024/ND-CP, which stipulates the authority to issue suspension decisions as follows:
Temporary Suspension, Suspension of Operations for Establishments, Motor Vehicles, Households, and Individuals Not Ensuring Fire Safety

8. Authority to temporarily suspend and suspend operations:
a) The Chairman of the People's Committee at the commune level decides to temporarily suspend and suspend operations for specific sections, entire establishments, motor vehicles, households, and individual activities under their management scope;
b) The Head of the Fire Prevention, Fighting, and Rescue Police Department at the provincial level, and the Head of the District Police within their management scope decide to temporarily suspend and suspend operations for specific sections, entire establishments, motor vehicles, households, and individual activities under their management scope, except for defense establishments operating for military purposes and motor vehicles with special requirements for fire safety manufactured or modified by defense establishments for military activities;
c) Police officers are authorized to temporarily suspend operations in cases specified in point a, clause 1 of this Article and must report to the direct authoritative manager specified in point a and point b of this clause for a formal suspension decision in the shortest time possible.
The authority to issue temporary suspension decisions is regulated as follows:
- The Chairman of the People's Committee at the commune level has the authority to issue temporary suspension decisions for specific sections, entire establishments, motor vehicles, households, and individual activities under their management scope.
- The Head of the Fire Prevention, Fighting, and Rescue Police Department at the provincial level, and the Head of the District Police have the authority to issue temporary suspension decisions for the above subjects, except for defense establishments operating for military purposes and motor vehicles with special requirements for fire safety.
- Police officers may temporarily suspend operations for the cases specified in point a, clause 1, Article 17 of Decree 136/2020/ND-CP and must report to the direct authoritative manager specified in point a and point b for a formal suspension decision in the shortest time possible.
Regulations on establishments under fire prevention and fighting management in Vietnam
Pursuant to clause 1, Article 4 of Decree 136/2020/ND-CP as amended by clause 1, Article 1 of Decree 50/2024/ND-CP, the establishments under fire prevention and fighting management are regulated as follows:
- Establishments stipulated in clause 3, Article 3 of the Law on Fire Prevention and Fighting 2001, as amended and supplemented by clause 1, Article 1 of the Amended Law on Fire Prevention and Fighting 2013, while operating, being suspended, or having their operations suspended, fall under fire prevention and fighting management.
A single organization may have one or multiple establishments; multiple organizations may coexist within a single establishment.
