Based on the provisions of Article 4 of Decree 115/2020/ND-CP, the recruitment of public employees is mentioned as follows:

Grounds for recruiting public employees

1. The recruitment of public employees must be based on the job requirements, job positions, professional title standards, and salary fund of the public service provider.

2. The agency or unit authorized to recruit public employees shall develop a recruitment plan, report it to the competent authority for management of public employees for approval or decide accordingly to be the basis for recruitment before each recruitment period. The recruitment plan includes:

a) The number of assigned employees and the number of employees not yet used by the public service provider using public employees;

b) The number of public employees needed to be recruited for each job position;

c) The number of job positions needed to be recruited for ethnic minorities (if any), whereby clearly defining the targets and the ethnic structure needed to be recruited;

d) Standards and conditions for registration for recruitment for each job position;

dd) Forms and contents of recruitment exams or reviews;

e) Other contents (if any).

Thus, according to the above regulations, the recruitment of public employees at public service providers is based on the following grounds:

- Job requirements;

- Job positions;

- Professional title standards;

- Salary fund of the public service provider.

Who will be given priority in the recruitment of public employees in Vietnam?

Based on Article 6 of Decree 115/2020/ND-CP, the subjects given priority in the recruitment of public employees are as follows:

- Heroes of the Armed Forces, Labor Heroes, war invalids, people benefiting from policies like war invalids, category B war invalids: An additional 7.5 points will be added to the result of round 2 points;

- Ethnic minorities, army officers, police officers, professional soldiers retiring, people working in key sectors transferred to other fields, graduates in officer training reserve, graduates in training commanders of the commune military headquarters in the grassroots military sector granted the rank of reserve officer who have registered as reserve officers, children of martyrs, children of war invalids, children of policy beneficiaries like war invalids, children of category B war invalids, biological children of people participating in resistance who were exposed to toxic chemicals, children of Heroes of the Armed Forces, children of Labor Heroes: An additional 5 points will be added to the result of round 2 points;

- People who have completed military service, duty in the People's Police, young volunteers: An additional 2.5 points will be added to the result of round 2 points.

Note: In cases where an individual applying for recruitment under multiple priority categories, only the highest priority score will be added to the result of round 2 points.

How many members are there in the Public Employee Recruitment Council in Vietnam?

Pursuant to Article 8 of Decree 115/2020/ND-CP, the regulations are as follows:

Public Employee Recruitment Council

1. In case the public service provider is authorized to recruit, the Recruitment Council consists of 05 or 07 members, including:

a) The Chairman of the Council is the head or the deputy head of the public service provider;

b) The Vice Chairman of the Council is the person in charge of personnel organization of the public service provider;

c) Member and Secretary of the Council is the public employee assisting with personnel organization of the public service provider;

d) Other members are people with expertise and experience related to the recruitment organized by the head of the public service provider. In case of not being able to appoint the Chairman of the Recruitment Council as prescribed in point a, the competent authority managing the public service provider shall consider and decide.

2. In case the competent authority managing the public service provider carries out the recruitment, the Recruitment Council consists of 05 or 07 members, including:

a) The Chairman of the Council is the head or the deputy head of the competent authority to recruit;

b) The Vice Chairman of the Council is the leader of the personnel organization advisory department of the competent authority to recruit;

c) Member and Secretary of the Council is the representative of the personnel organization advisory department of the competent authority to recruit;

d) Other members are people with expertise and experience related to the recruitment organized by the head of the competent authority to recruit.

Thus, the Public Employee Recruitment Council will have 5 or 7 members, including:

- The Chairman of the Council is the head or the deputy head of the public service provider;

- The Vice Chairman of the Council is the person in charge of personnel organization of the public service provider;

- Member and Secretary of the Council is the public employee assisting with personnel organization of the public service provider;

- Other members are people with expertise and experience related to the recruitment organized by the head of the public service provider.

In case of not being able to appoint the Chairman of the Recruitment Council as prescribed in point a, the competent authority managing the public service provider shall consider and decide.
