According to Article 12 of Regulation 69-QD/TW in 2022 stipulates as follows:

"Article 12: Violations of election regulations

1. Violating one of the following cases, causing not very serious consequences will be disciplined by reprimand:

a) Lacking responsibility in leadership, directing, and guiding the filling of candidacy and nomination forms or verifying the personal history of the candidates, leading to violations during the election process.

b) Directing and organizing elections not in accordance with principles, procedures, and election procedures, leading to errors, violations, or fraud in elections.

c) Neglecting leadership, directing, and organizing the work of election protection according to the regulation, resulting in acts of disturbance or obstruction, sabotage causing loss of security and order at the election site.

d) Lacking responsibility in directing, organizing the assessment and approval of personnel, leading to the introduction and nomination of persons who do not meet the standards and conditions to be elected to leadership and management positions of the Party organization, state agencies, the Fatherland Front, and socio-political organizations.

2. For first-time violations of the cases specified in Clause 1 of this Article that cause serious consequences or re-violation or violation of one of the following cases, the discipline shall be in the form of a warning:

a) Having a policy of campaigning for self-nomination, acceptance of nomination, and nomination to leadership and management positions of the Party organization, state agencies, the Fatherland Front, and socio-political organizations contrary to regulations.

b) Neglecting leadership leading to exploiting campaigns or manipulating collectives to introduce and elect persons who do not meet the standards and conditions to leadership and management positions of the Party organization, state agencies, the Fatherland Front, and socio-political organizations.

c) Neglecting leadership, lacking responsibility for inspection, and supervision leading to serious violations of the election principles.

d) Knowing that a member of the Party committee or Party organization has an act of bribery, inciting, coercing others, or campaigning illegally or contrary to the leadership of the Party committee, but not promptly preventing or handling.

3. Discipline by dissolution in case of having a policy, action against the policy, regulations of the Communist Party, and state laws on election work causing particularly serious consequences."

How was disciplinary action in elections handled previously?

According to Article 9 of Regulation 102-QD/TW in 2017 stipulates as follows:

"Article 9: Violations of election regulations

1- Communist Party members who violate one of the following cases causing not very serious consequences will be disciplined by reprimand:

a) Assigned the task of organizing and implementing elections but lacking responsibility for checking, verifying, and reviewing candidacy documents.

b) Not correctly implementing or fully following the principles, procedures, and rules about election.

c) Not fulfilling one's rights and obligations about elections as regulated by law or having acts causing loss of security and order at the election site.

2- In case of having been disciplined as prescribed in Clause 1 of this Article and then re-violating or committing a first-time violation causing serious consequences, or violating one of the following cases, the discipline shall be in the form of a warning or demotion (if holding a position):

a) Abusing position, power, or influence of a position or power to impact, pressure authorities to nominate relatives into leadership positions of the Party organization, state agencies, the Fatherland Front, socio-political organizations.

b) Self-nomination, acceptance of nomination, and nomination to positions of the state, the Fatherland Front, and socio-political organizations (as regulated must be introduced by the Party) without permission from the competent Party organization.

c) Being responsible for verifying and reviewing personnel but intentionally introducing ineligible and unqualified individuals to be elected to leadership positions of the Party organization, state agencies, the Fatherland Front, socio-political organizations.

d) Being dishonest in vote counting, announcing election results; having fraudulent acts in implementing election regulations.

đ) Having acts of bribery, inciting, coercing, or campaigning contrary to regulations; obstructing and intimidating others performing their rights to run, nominate, or vote as regulated by the Communist Party and state laws.

e) Being dishonest in declaring, commenting, confirming, or verifying candidacy documents, history, assets, and income of the candidate as regulated in the election.

3- In case of violating the regulations in Clause 1 or Clause 2 of this Article causing very serious consequences or violating one of the following cases, discipline shall be in the form of expulsion:

a) Organizing for faking documents, vote fraud, or distorting the election results.

b) Having acts or deeds sabotaging the election.

c) Organizing forces, factions, kinfolk to campaign for self-nomination, receiving nomination, and nomination to the positions of the state, the Fatherland Front, socio-political organizations contrary to regulations."
