Are the companies allowed to arbitrarily change the working hours of employees?
According to Article 44 of Decree 145/2020/ND-CP, the regulations are as follows:
Content and forms of employee consultation
1. Employees shall be consulted on the following contents:
a) Formulating, amending, supplementing internal rules, regulations, and other documents of the employer related to the rights, obligations, and benefits of employees;
b) Formulating, amending, supplementing wage scales, wage tables, labor norms; proposing contents for collective bargaining;
c) Proposing and implementing solutions to save costs, increase labor productivity, improve working conditions, protect the environment, prevent and fight fires and explosions;
d) Other contents related to the rights, obligations, and benefits of employees as prescribed by law.
2. For the contents specified in Clause 1 of this Article for which the law specifies the form of employee consultation, the specified form shall be followed; where the law does not specify a form, the employees shall base on the production, business characteristics, labor organization, the content to be consulted, and the grassroots democracy regulations at the workplace to choose one of the following forms:
a) Direct consultation or through the grassroots employee representative organization, the employee dialogue group at the employee conference, dialogue at the workplace;
b) Directly sending feedback, suggestions;
c) Other forms not prohibited by law.
Thus, changing the working hours of employees will affect the rights, obligations, and benefits of employees, specifically their rest time.
Therefore, the company cannot arbitrarily change employees' working hours without consulting the employees.
Note: If the law specifies the form of employee consultation, it must be followed. If the law does not specify a form, employees shall base on the production, business characteristics, labor organization, the content of consultation, and grassroots democracy regulations at the workplace to choose one of the following forms:
+ Direct consultation or through the grassroots employee representative organization, the employee dialogue group at the employee conference, dialogue at the workplace;
+ Directly sending feedback, suggestions;
+ Other forms not prohibited by law.
What are the normal working hours of employees in Vietnam?
According to Article 105 of the Labor Code 2019, the regulations are as follows:
Normal working hours
1. Normal working hours shall not exceed 08 hours per day and 48 hours per week.
2. Employers have the right to establish working hours by day or week but must notify employees; in the case of weekly working hours, normal working hours shall not exceed 10 hours per day and 48 hours per week.
The State encourages employers to apply a 40-hour workweek for employees.
3. Employers are responsible for ensuring that the working time exposure to hazardous, harmful factors complies with national technical standards and relevant laws.
Thus, the normal working hours of employees shall not exceed 08 hours per day and 48 hours per week.
Note:
+ Employers have the right to establish working hours by day or week but must notify employees; in the case of weekly working hours, normal working hours shall not exceed 10 hours per day and 48 hours per week.
+ The State encourages employers to apply a 40-hour workweek for employees.
How is the overtime and night work pay calculated for employees in Vietnam?
According to Article 98 Labor Code 2019, the overtime and night work pay is regulated as follows:
(1) Employees working overtime shall be paid according to the wage unit or the actual wage of the current job as follows:
+ On weekdays, at least 150%;
+ On weekly days off, at least 200%;
+ On public holidays, New Year holidays, paid leaves, at least 300% not including wage for public holidays, New Year holidays, paid leaves for employees receiving daily wages.
(2) Employees working at night shall be paid at least 30% additional compared to the wage calculated according to the wage unit or actual wage of the job performed during normal working hours of the day.
(3) Employees working overtime at night, in addition to the pay stipulated in (1) and (2), shall be paid an additional 20% of the wage unit or the wage of the job performed during the day of the same normal workday or weekly day off or public holiday, New Year holiday.
(4) the Government of Vietnam provides detailed regulations for Article 98 of the Labor Code 2019.
