2. Appendix II: List of facilities at risk of fire and explosion.

According to Appendix II attached to Decree 50/2024/ND-CP, it stipulates the List of facilities at risk of fire and explosion in Vietnam.

According to Appendix II attached to Decree 50/2024/ND-CP, the List of facilities at risk of fire and explosion includes:

(1) Headquarters of state agencies at all levels with 10 or more floors or with a total building volume of 25,000 m³ or more.

(2) Apartment buildings, dormitories, and collective houses with 7 or more floors or with a total volume of 10,000 m³ or more; mixed-use buildings with 5 or more floors or with a total volume of 5,000 m³ or more.

(3) Daycare centers, kindergartens, preschools with 350 or more children or with a total volume of educational and service buildings of 5,000 m³ or more;

Primary schools, secondary schools, high schools, and multi-level schools with a total volume of educational and service buildings of 5,000 m³ or more;

Colleges, universities, academies, professional secondary schools, vocational training schools, continuing education institutions with 7 or more floors or with a total building volume of 10,000 m³ or more;

Other educational institutions established under the Education Law with a total volume of 5,000 m³ or more.

(4) Hospitals with 250 or more beds; multi-specialty clinics, specialized clinics, nursing homes, rehabilitation centers, orthopedic centers, elder care homes, disease prevention facilities, medical centers, and other healthcare institutions established under the Law on Examination and Treatment with 5 or more floors or with a total volume of 5,000 m³ or more.

(5) Theaters, cinemas, circuses with 600 or more seats; conference centers, event venues, cultural houses with 5 or more floors or with a total building volume of 10,000 m³ or more; karaoke businesses, nightclubs, bars, clubs with 5 or more floors or with a total business volume of 5,000 m³ or more; amusement parks, zoos, aquariums with a volume of 5,000 m³ or more.

(6) Grade 1 and Grade 2 markets; malls, electronic stores, supermarkets, service businesses, dining establishments, and businesses dealing in flammable or explosive goods with a total business area of 500 m² or more or with a total business volume of 5,000 m³ or more.

(7) Hotels, guest houses, inns, and other lodging facilities established under the Tourism Law, hostels with 7 or more floors or with a total lodging service volume of 10,000 m³ or more.

(8) Buildings used as headquarters, offices of enterprises, political organizations, social organizations with 7 or more floors or with a volume of 10,000 m³ or more.

(9) Museums, libraries, exhibition halls, display houses, archives, bookstores, fair houses with a volume of 10,000 m³ or more.

(10) Buildings serving postal stations, mail processing facilities, telecommunications facilities with 5 or more floors or with a total volume of 10,000 m³ or more; data storage and management centers, broadcasting and television facilities, publication, and printing facilities with a total volume of 5,000 m³ or more.

(11) Stadiums with 40,000 or more seats; indoor sports arenas, gymnasiums with 500 or more seats; sports centers, race tracks, shooting ranges with a total sports building volume of 10,000 m³ or more or with a capacity of 5,000 or more seats; other sports facilities established under the Law on Physical Training and Sports with a volume of 5,000 m³ or more.

(12) Airports; air traffic control towers; seaports; inland ports; Grade I and Grade II inland waterways ports; Grade I and Grade II bus stations; Grade I rest areas; Grade I and Grade II railway stations; cable car waiting rooms with a volume of 5,000 m³ or more; subway constructions; vehicle inspection facilities; service facilities for the business, repair, and maintenance of motor vehicles with a business area of 500 m² or more or with a total business volume of 5,000 m³ or more.

(13) Parking garages with a capacity of 50 or more cars.

(14) Nuclear facilities; facilities for the production, business, storage, and use of industrial explosives and explosive precursors; industrial explosive warehouses, explosive precursors warehouses; import and export ports of industrial explosives, explosive precursors; weapon and support tool warehouses.

(15) Facilities for the extraction, processing, production, transportation, business, and storage of petroleum and petroleum products, land-based gas; oil and gas warehouses, gas warehouses; import and export ports of petroleum products, gas; filling stations for petrol and oil; businesses dealing in flammable liquids, and businesses dealing in gas with a total gas capacity of 200 kg or more.

(16) Industrial establishments with a fire and explosion hazard grade A, B with a total production technology building volume of 5,000 m³ or more; grade C with a total production technology building volume of 10,000 m³ or more; grade D, E with a total production technology building volume of 15,000 m³ or more.

(17) Power plants; transformer stations with a voltage of 110 kV or more.

(18) Tunnels involved in the production, storage, and use of flammable and explosive substances; national reserve warehouses; warehouses for flammable goods and materials with a total volume of 5,000 m³ or more.

What is the minimum coverage of compulsory fire and explosion insurance in Vietnam?

According to Article 24 of Decree 67/2023/ND-CP, the minimum coverage is stipulated as follows:

Minimum coverage

1. The minimum compulsory fire and explosion insurance amount is the value converted into money according to the market price of the assets specified in Clause 1, Article 23 of this Decree at the time of concluding the insurance contract.

2. In cases where the market price of the assets cannot be determined, the compulsory fire and explosion insurance amount is agreed upon by the parties as follows:

a) For the assets specified at Point a, Clause 1, Article 23 of this Decree: The insurance amount is the value converted into money of the assets according to the remaining value or replacement value of the assets at the time of concluding the insurance contract.

b) For the assets specified at Point b, Clause 1, Article 23 of this Decree: The insurance amount is the value converted into money of the assets According to valid invoices, documents, or related documents.

Hence, the minimum compulsory fire and explosion insurance amount is the value converted into money according to the market price of the assets stipulated in Clause 1, Article 23 of Decree 67/2023/ND-CP at the time of concluding the insurance contract.

If the market price of the assets cannot be determined, the compulsory fire and explosion insurance amount is agreed upon by the parties as follows:

- For houses, buildings, and assets attached to houses and buildings; machinery and equipment: The insurance amount is the value converted into money of the assets according to the remaining value or replacement value of the assets at the time of concluding the insurance contract.

- For types of goods and materials (including raw materials, semi-finished products, finished products): The insurance amount is the value converted into money of the assets According to valid invoices, documents, or related documents.
