The detailed guidelines on fill out the application for land-related change registration in Vietnam in 2024 under Decree 101 on the issuance of LURCs are as follows:

(1) For households, individuals, communities, and Vietnamese people residing abroad, write “Land Registration Office/Branch of Land Registration Office......” where the land is located;

For domestic organizations, religious organizations, subordinate religious organizations, foreign-invested economic organizations, foreign organizations with diplomatic functions, foreign organizations, and foreign individuals, write “Land Registration Office...” where the land is located.

(2) Fill in the information as on the issued certificate. In case of transfer of land use rights or ownership rights of assets attached to the land, provide the information of the transferee.

(3) Fill in the information as on the issued certificate.

In case of loss of the certificate, if the certificate holder does not have information about the issued certificate, do not declare the content in this section; the administrative procedure resolution agency will check the cadastral records and land data to determine the information in this section, including mandatory information from points 2.1 and 2.3.

(4) State the change details such as: “receiving transfer, receiving donation..., reissuing Certificate due to loss, renewing Certificate...”.

(5) List the types of documents submitted with this Application.

What is the time limit for for registration of land-related changes and issuance of LURCs in Vietnam?

Based on Clause 2 Article 22 of Decree 101/2024/ND-CP, the time limit for for registration of land-related changes and issuance of LURCs in Vietnam is as follows:

(1) For agricultural land use rights conversion without land consolidation or in case of transfer, inheritance, donation of land use rights, ownership of assets attached to the land, capital contribution by land use rights, ownership of assets attached to land, it should not exceed 10 working days;

(2) In case of selling or contributing capital with assets attached to the land leased by the State with annual land rent, it should not exceed 10 working days, excluding the time to determine land prices and sign land lease contracts;

(3) For leasing or sub-leasing land use rights in infrastructure business projects, it should not exceed 05 working days;

(4) For deregistration of leasing or sub-leasing land use rights in infrastructure business projects, it should not exceed 03 working days;

(5) For change of name or information about land users or owners of assets attached to the land, it should not exceed 05 working days; in case of reduction of parcel area due to natural landslides, it should not exceed 10 working days;

(6) For changing the restrictions on land use rights, ownership of assets attached to land, or changing rights to adjacent parcels, it should not exceed 07 working days;

(7) For households, individuals establishing private enterprises and using land for business operation of the enterprises, it should not exceed 10 working days, excluding the time to determine land prices and sign land lease contracts;

(8) For registering ownership of assets attached to the parcel that has been issued a Certificate, it should not exceed 10 working days; for assets already certified on the issued Certificate but registered with asset changes, it should not exceed 07 working days;

(9) For changing land use rights, ownership of assets attached to land due to division, separation, consolidation, merger, organizational change, or agreement between family members or husband and wife or group of land users, common owners of assets attached to land, it should not exceed 08 working days;

(10) For acquiring land use rights, ownership of assets attached to land according to the results of successful mediation of land disputes, complaints, denunciations about land, it should not exceed 08 working days;

(11) For acquiring land use rights, ownership of assets attached to land due to handling of mortgaged assets, it should not exceed 08 working days;

(12) For changes in land use rights for construction of surface works serving the operation, exploitation, use of underground works, ownership of underground works, it should not exceed 15 working days;

(13) For selling assets, transferring, transferring land use rights as public property according to the law on management and use of public property, it should not exceed 10 working days;

(14) For debt clearing of land levy, registration fee, the resolution time is within the working day of receiving a complete debt clearing file; if the complete file is received after 15:00 on the same day, the debt clearing can be resolved the next working day;

(15) For issuing Certificates for land use rights, ownership of assets attached to land according to detailed construction planning or adjustment of detailed construction planning of investment projects using land which adjusts detailed construction planning in accordance with the law on construction or if the project investor has been issued a Certificate for the entire project land area but requests Certificates for individual parcels according to approved detailed construction planning, it should not exceed 05 working days;

(16) For registering land use change as defined in Clause 3 Article 121 of Land Law 2024, it should not exceed 10 working days.

What is the effective date of Decree 101/2024/ND-CP?

Based on Article 67 of Decree 101/2024/ND-CP, the effective date is as follows:

- Decree 101/2024/ND-CP takes effect from August 1, 2024.

- The following decrees will be voided from August 1, 2024:

+ Decree 43/2014/ND-CP.

+ Decree 01/2017/ND-CP.

+ Decree 148/2020/ND-CP.

+ Decree 10/2023/ND-CP.

- Repeal some articles and clauses of the following Decrees:

+ Clauses 1 and 2 Article 1 of Decree 136/2018/ND-CP.

+ Article 11 of Decree 104/2022/ND-CP.
