Based on Clause 1, Article 3 of Decree 42/2022/ND-CP stipulates as follows:

“Article 3. Interpretation of terms

In this Decree, the following terms are understood as follows:

1. a web portal is the access point of an agency on the network environment, linking, integrating information channels, services, and applications through which users can exploit, use, and personalize the display of information.”

What information will regulatory bodies disclose on the web portal?

Based on Article 4 of Decree 42/2022/ND-CP stipulates as follows:

“Article 4. Information provided on the network environment

1. regulatory bodies publicly disclose on the network environment information for organizations and individuals according to the Law on Access to Information, the Law on Information Technology, ensuring the provision of the following information:

a) Legal documents and administrative management documents within the authority to issue or assigned to draft, clearly stating: document form, issuing authority, code number, date of issuance, effective date, summary, downloadable document file, providing a document search tool.

The provision of information on legal documents complies with legal provisions and ensures synchronization with the national database on legal documents or the Gazette of the Government of the Socialist Republic of Vietnam.

b) International treaties to which the Socialist Republic of Vietnam is a member, international agreements to which Vietnam is a party.

c) Administrative procedures, online public services, work process of regulatory bodies in accordance with the provisions of law, ensuring uniformity, integration from the National Public Service Portal, the public service portal at the ministry and provincial levels.

d) Information on dissemination, guidance on legal implementation, policies, within the management scope of the state agency.

2. In addition to the information stipulated in Clause 1 of this Article, regulatory bodies may provide other information according to their authority.

3. Information provided by regulatory bodies on the network environment must be updated promptly after any change.”

Thus, regulatory bodies will publicly disclose the above-mentioned information on the web portal.

What are communication channels of regulatory bodies to provide online information for organizations and individuals in Vietnam?

Based on Article 5 of Decree 42/2022/ND-CP stipulates as follows:

“Article 5. communication channels

1. Websites or web portals of regulatory bodies (hereinafter collectively referred to as web portals of regulatory bodies) serve as unified, centralized communication channels of regulatory bodies on the network environment.

2. Based on specific conditions, regulatory bodies deploy the following communication channels for organizations and individuals on the network environment:

a) Ministry and provincial-level data portals

Ministry-level data portals integrate with the national data portal and serve as components of the web portal of ministries, ministry-level agencies, and agencies under the Government of Vietnam; provincial-level data portals integrate with the national data portal and serve as components of the web portal of the People's Committees of provinces, centrally run cities.

b) Social networks allowed by regulatory bodies to provide information on the network environment following legal regulations.

c) Email.

d) Applications on mobile devices allowed by regulatory bodies to provide information on the network environment, deployed in a centralized, unified manner, shared within ministries, central authorities, and local authorities to provide information of regulatory bodies on the network environment, avoiding duplication.

đ) Telephone hotlines.

3. regulatory bodies announce communication channels on the network environment. These channels must meet the following requirements:

a) Ensure convenient access through various means, including mobile devices.

b) Allow organizations and individuals to evaluate online the level of satisfaction with the provided information. regulatory bodies ensure the confidentiality and privacy of evaluating organizations and individuals.

c) Ensure network information security; apply standards and technologies to support persons with disabilities in accessing and using information and communication products and services; comply with technical regulations on information provision on the network environment.

d) The Ministry of Information and Communications guides standards supporting persons with disabilities in accessing and using information and communication products and services; provides information on the network environment.

4. Organizations and individuals have the right to choose channels provided by regulatory bodies to access and use information of regulatory bodies on the network environment and are responsible for complying with regulations in the use of information on the network environment.”

Users who wish to view unified, centralized information of regulatory bodies on the network environment will do so through the websites or web portals provided by regulatory bodies.

Decree 42/2022/ND-CP takes effect from August 15, 2022.
