Who are public security workers in Vietnam?

Pursuant to the provisions of Clause 6, Article 2 of the 2018 Law on People's Public Security, public security workers are regulated accordingly:

6. Public security worker means a Vietnamese citizen who has professional and technical qualifications, is recruited to the People’s Public Security Force but is not permissible to be bestowed to the rank of officer, non-commissioned officer or serviceman.

How are wages and policies for public security workers regulated in Vietnam?

Pursuant to the provisions of Article 9 of Decree 49/2019/ND-CP stipulating the salary regime for public security workers as follows:

- Salary tables for public security workers specified in the Appendix promulgated together with this Decree.

The Minister of Public Security shall prescribe job titles for each group and salary rank.

- Raising wages and quotas for public security workers

+ Public security workers who complete the assigned work, meet the prescribed technical rank standards and have not yet ranked the last salary rank in the rank shall be considered for a regular salary upgrade after 2 years (full 24 months) to keep the salary level for those with a salary coefficient of 3.95 or less and after 3 years (full 36 months) to keep the salary level for those with the above salary coefficient 3,95.

During the salary upgrade consideration period, if the task is not completed or disciplined in the form of reprimand, the salary upgrade period shall be extended by 06 months; if disciplined in the form of a warning or more, extend the salary upgrade period by 12 months.

In case of establishing exceptionally excellent achievements in the performance of tasks, the salary level shall be raised up to 12 months or outstandingly before the deadline;

+ Public security workers who successfully complete or successfully complete their assigned duties and tasks, have the capacity to assume higher job positions in the same industry, professional and technical professions, and have appropriate diplomas, shall be considered for promotion.

- Transfer of wages to The Wages of public security Workers

+ When transferring salary arrangements, it is not allowed to combine salary increases or salary increases;

+ The transfer of salary from the current salary coefficient to the salary coefficient specified in the Salary Table of public security workers issued in the Appendix attached to this Decree is based on the period of work with social insurance contributions (if there is a period of intermittent social insurance contributions without enjoying the one-time social insurance allowance, it will be accumulated), in accordance with the job position and specified in Clause 2 of this Article.

In case there is a newly ranked salary coefficient plus a seniority allowance exceeding the framework lower than the current salary coefficient plus the excess seniority allowance and allowance for defense and security services, the reserve difference coefficient shall be equal to the total salary coefficient, excess seniority allowances and allowances for defense and security services. The reserved difference coefficient gradually decreases when the salary level is raised.

- Public security workers are entitled to various types of allowances and allowances including:

+ Excess seniority allowance;

+ Regional allowances;

+ Special allowances;

+ Toxic and dangerous allowances;

+ Allowance for work responsibilities;

Conditions, duration and benefits of allowances at Points a, b, c, d and dd of this Clause shall be implemented as prescribed in the Government's Decree 204/2004/ND-CP dated December 14, 2004 on the salary regime for cadres, civil servants, public employees and the armed forces.

+ Civil service allowance:

Applicable to public security workers receiving salaries from the state budget;

Conditions, duration and level of civil service allowances shall be implemented as prescribed in decree 34/2012/ND-CP dated April 15, 4 of the Government on civil service allowances.

+ Allowances and allowances for work in areas with extremely difficult socio-economic conditions:

Conditions, time and enjoyment levels shall be implemented as prescribed in the Government's Decree 116/2010/ND-CP dated December 24, 2010 on policies for cadres, civil servants, public employees and salary recipients in the armed forces working in areas with extremely difficult socio-economic conditions.

- Funding for implementation

+ For estimating units guaranteed by the state budget in accordance with the law on state budget;

+ For enterprises that are included in deductible expenses when determining the taxable income of the enterprise.

- Public security workers applying the salary table specified in this Decree are not entitled to allowances for national defense and security services specified at Point dd Clause 8 Article 6 of the Government's Decree 204/2004/ND-CP dated December 14, 2004 on the salary regime for cadres, civil servants, civil servants and the armed forces.
