When to consider raising the pay step ahead of time in the People's Court?

According to Article 8 of the Regulation on raising the pay step ahead of time enclosed with Decision 932/QD-TANDTC 2017 of Vietnam as follows:

"Article 8. Procedure for considering raising pay step ahead of time
1. For the Supreme People's Court:
Step 1. In February every year, the Head of the unit under the Supreme People's Court holds a meeting with the Party Committee and Executive Committee of the Trade Union at the same level to comment on the level of achievements in performing their duties to each individual of the unit and make a list of those who meet the conditions, standards and number of months of raising pay step ahead of time of the unit to send to the Organization and Personnel Department of the Supreme People's Court for general synthesis.
Step 2. The Department of Organization and Personnel summarizes a list from the units and submits it to the Council for consideration of raising pay step ahead of time of the Supreme People's Court meeting, to consider and decide on raising pay step ahead of time for each case submitted by the Department of Organization and Personnel.
Step 3. Based on the results of step 3, the Department of Organization and Personnel shall publicly announce the list of people who have been promoted to pay step ahead of time at the unit and the agency's bulletin board within 05 working days before submitting it to the competent authority signing the decision to raise the pay step ahead of time.
2. For the High People's Court; The People's Courts of provinces and centrally run cities shall follow the steps prescribed in Clause 1 of this Article."

What are the dossiers of application for consideration of raising the pay step ahead of time in the People's Court?

According to Article 9 of the Regulation on raising the pay step ahead of time enclosed with Decision 932/QD-TANDTC 2017 of Vietnam stipulating the application for consideration of raising the pay step ahead of time as follows:

Dossier to request for raising the pay step ahead of time includes:

- Official letter and list of request for raising the pay step ahead of time signed by the head of the unit (under form 01);

- Minutes of the meeting to consider raising the pay step ahead of time of the unit (made according to form No. 02);

- Decision to raise the latest regular pay step ahead of time;

- A copy (copy) of the achievements of the person proposed to be considered for raising the pay step ahead of time.

Who has the authority to decide to raise the pay step ahead of time in the People's Court?

According to Article 6 of the Regulation on raising the pay step ahead of time enclosed with Decision 932/QD-TANDTC 2017 of Vietnam as follows:

"Article 6. Authority to decide to raise the pay step ahead of time
The authority to decide to raise the pay step ahead of time for cadres, civil servants and public employees in the People's Courts is carried out according to the decentralization of management and management of cadres, civil servants and public employees.”

According to Article 7 of the Regulation on raising the pay step ahead of time enclosed with Decision 932/QD-TANDTC 2017 of Vietnam as follows:

"Article 7. Council for consideration of raising the pay step ahead of time
1. Establishment of a council to consider raising the pay step ahead of time
a) The Council for consideration of raising the pay step ahead of time of the Supreme People's Court is established by the decision of the Chief Justice of the Supreme People's Court, consisting of the following members:
- Chairman of the Council: Representative of Leaders of the Supreme People's Court;
- Members of the Council include:
+ Representative of the Leadership Department of Organization and Personnel
- Representative of the Leadership Department of Emulation-Reward.
+ Representative of the Executive Committee of the Trade Union of the Supreme People's Court.
+ Representative of the Executive Committee of the Ho Chi Minh Communist Youth Union of the Supreme People's Court.
- Secretary of the Council: 01 civil servant in the Department of Organization and Personnel.
b) The Council for consideration of raising salary grade before the deadline of the non-business unit (when decentralized to manage) is established by decision of the leader of the non-business unit, consisting of the following members:
- Chairman of the Council: Representative of leaders of non-business units;
Council members:
+ Representative of the Organization and Personnel Department. Council Secretary.
+ Representative of the department doing Emulation-Reward work
+ Representative of the Executive Committee of the Trade Union
+ Representative of the Executive Committee of the Ho Chi Minh Communist Youth Union of the unit.
c) The Council for consideration of raising salary grades ahead of time of the Superior People's Court is established by the decision of the Chief Justice of the High People's Court, consisting of the following members:
- Chairman of the Council: Representative of the Leadership of the High People's Court;
Council members:
+ Representative Office Leader.
+ Representative of the Leaders of the Department of Organization, Personnel, Inspection, Emulation and Reward. Council Secretary.
+ Representative of the Executive Committee of the Trade Union of the agency.
+ Representative of the Executive Committee of the Ho Chi Minh Communist Youth Union of the agency.
d) The Council of the People's Court of the province or centrally run city is established by the decision of the Chief Justice of the People's Court of the province, consisting of the following members:
- Chairman of the Council: Representative of Leaders of the Provincial People's Court;
Council members:
+ Representative Office Leader.
+ Representative of the Department of Organization - Personnel, Inspection and Emulation - Commendation. Council Secretary.
+ Representative of the Executive Committee of the Trade Union of the agency.
+ Representative of the Executive Committee of the Ho Chi Minh Communist Youth Union of the agency.
2. Tasks of the Council for consideration of raising the pay step ahead of time
The Council for consideration of raising the pay step ahead of time shall, based on the provisions of law and this Regulation, consider and approve the list of civil servants, public employees, and employees who fully meet the conditions and criteria for raising the pay step ahead of time for submission to competent authorities for consideration and decision. The Council for consideration of raising the pay step ahead of time dissolves itself after completing the task."

Thus, according to this Regulation, in February every year, the head of the unit under the Supreme People's Court holds a meeting to comment on the level of achievement in performing tasks for each individual of the unit and make a list of those who are eligible, qualified and number of months to be promoted to the pay step ahead of time of the unit.
