What is social insurance according to Vietnamese regulations?

Pursuant to the provisions of Clause 1, Article 3 of the Law on Social Insurance 2014 of Vietnam, the concept of social insurance is specified as follows:

“Article 3. Interpretation of terms
In this Law, the terms below are construed as follows:
1. Social insurance means the guarantee to fully or partially offset an employee’s income that is reduced or lost due to his/her sickness, maternity, labor accident, occupational disease, retirement or death, on the basis of his/her contributions to the social insurance fund.”

How many types of social insurance are there in Vietnam?

As for the regulations on social insurance, there are currently 2 types of social insurance: compulsory social insurance and voluntary social insurance.

Compulsory social insurance is a type of social insurance organized by the State in which employees and employers must participate.

Voluntary social insurance is a type of social insurance organized by the State in which participants can choose the payment level and payment method suitable to their income and the State has a policy to support social insurance contributions for participants to enjoy the pension and death regime.

What are the regimes of social insurance in Vietnam?

Article 4 of the 2014 Law on Social Insurance provides for specific social insurance regimes as follows:

“Article 4. Social insurance regimes
1. Compulsory social insurance covers the following regimes:
a/ Sickness;
b/ Maternity;
c/ Labor accident and occupational disease;
d/ Retirement;
dd/ Survivorship allowance.
2. Voluntary social insurance covers the following regimes:
a/ Retirement;
b/ Survivorship allowance.
3. The supplementary retirement scheme shall be stipulated by the Government.”

What are the principles of social insurance in Vietnam?

Article 5 of the Law on Social Insurance 2014 stipulates the principles when participating in social insurance as follows:

“Article 5. Social insurance principles
1. Levels of social insurance allowances shall be calculated based on the social insurance premium rate, the premium payment period and the sharing among the insured.
2. The compulsory social insurance premium rate shall be calculated based on an employee’s monthly salary. The voluntary social insurance premium rate shall be calculated based on the monthly income selected by employees.
3. Employees who pay both compulsory and voluntary social insurance premiums are entitled to the retirement regime and survivorship allowance regime based on their period of social insurance premium payment. The period of social insurance premium payment already calculated for enjoying a lump-sum social insurance allowance shall not be included in the period used to calculate social insurance regimes.
4. The social insurance fund shall be managed in a centralized, uniform, public and transparent manner; used for proper purposes and independently accounted by component funds and groups of the insured subject to the state-prescribed salary regime and the employer-decided salary regime.
5. Social insurance shall be implemented in a simple, easy and convenient manner, promptly and fully ensuring the interests of the insured.”

What benefits are employees entitled to when participating in social insurance in Vietnam?

According to the provisions of Article 18 of the Law on Social Insurance 2014, the benefits of employees when participating in social insurance are as follows:

(1) To participate in and enjoy social insurance regimes in accordance with this Law.

(2) Issuance and management of social insurance books.

(3) Receive full and timely pensions and social insurance benefits, in one of the following forms of payment:

- Directly from the social insurance agency or service organization authorized by the social insurance agency;

- Through the employee's deposit account opened at the bank;

- Through the employer.

(4) Enjoy health insurance in the following cases:

- Being on a pension;

- During maternity leave when giving birth or adopting a child;

- Leave work to receive monthly allowances for labor accidents and occupational diseases;

- Being entitled to sickness benefits for sick employees on the list of diseases requiring long-term treatment issued by the Ministry of Health.

(5) To take the initiative to go to the examination for assessment of the level of working capacity impairment if it falls under the case specified at Point b, Clause 1, Article 45 of this Law and is reserving the time to pay social insurance premiums; be paid medical examination fees if eligible for social insurance.

(6) Authorize others to receive pensions and social insurance benefits.

(7) Every 06 months, the employer provides information on social insurance contributions; annually be certified by the social insurance agency for social insurance contributions; to request employers and social insurance agencies to provide information on social insurance contributions and benefits.

(8) Complaints, denunciations and lawsuits about social insurance in accordance with the provisions of law.
