What is the validity period of a written residence information confirmation in Vietnam?

Under the provisions of Article 17 of Circular 55/2021/TT-BCA (amended by Clause 9, Article 1 of Circular 66/2023/TT-BCA) as follows:

Residence information confirmation
1. Each citizen may send a request for residence information confirmation to a registration authority across the country regardless of his/her place of residence in person at its head office or via the national public service portal, VNeID application or other online public services according to regulations of law.
2. Residence information to be verified includes current place of residence, previous places of residence, period of residence at each place, residence registration type, and other residence information available in the residence database and the national population database. Residence information confirmation shall be valid for 01 year from the date on which the confirmation is made. In case the residence information of a citizen has been changed or adjusted and the change is updated to the residence database, residence information confirmation shall become invalid from the time of such change or adjustment.
3. The registration authority shall verify residence information at the request of the citizen. If the residence information to be verified is available in the national population database, the period of confirmation shall not exceed a half of working day. If the information to be verified is not available in the national population database or the residence database, the period of confirmation shall not exceed 03 working days.”.

Thus, the residence information confirmation shall be valid for 01 year from the date on which the confirmation is made.

In case the residence information of a citizen has been changed or adjusted and the change is updated to the residence database, residence information confirmation shall become invalid from the time of such change or adjustment.

Compared to before, Article 17 of Circular 55/2021/TT-BCA clearly states as follows:

Residence information confirmation
1. Citizens wishing to have their residence information verified may visit registration authorities across the country regardless of their places of residence to request such confirmation or send a request for residence information confirmation via the national public service portal, public service portal of the Ministry of Public Security or public service portal for residence management.
2. Residence information that may be verified includes residence registration time, location and type. Residence information confirmation shall be valid for 06 months starting from the date on which the confirmation is made for the cases mentioned in Clause 1 Article 19 of the Residence Law if residence declaration is verified and valid for 30 days starting from the date on which the confirmation is made if residence information is verified. In case residence information of a citizen has changed and the change is updated to the residence database, residence information confirmation shall become invalid from the time of such change.
3. Within 03 working days, the registration authority shall verify residence information in writing (with signature and stamp of head of the registration authority) or via electronic documents (with digital signature of head of the registration authority) at the request of the citizen.
4. In case a piece of information on an individual or a household needing to be verified is not yet updated to the residence database, the registration authority shall provide the citizen with instructions on revision of residence information in the residence database according to regulations in Article 26 of the Residence Law.

Accordingly, before January 1, 2024, the validity period of a written residence information confirmation in Vietnam is specified as follows:

- Residence information confirmation shall be valid for 06 months starting from the date on which the confirmation is made for the cases in which the place of residence of a person without permanent and temporary residences as they are ineligible for permanent and temporary residence registration shall be their current residence; if they do not live at a certain address, their current residence shall be the commune-level administrative unit where they are living. Persons without permanent and temporary residences must declare information on their residence with the registration authority of the locality where their current residence is located.

- Residence information confirmation shall be valid for 30 days starting from the date on which the confirmation is made if residence information is verified.

In case the residence information of a citizen has changed and the change is updated to the residence database, residence information confirmation shall become invalid from the time of such change

Thus, in 2024, the validity period of a written residence information confirmation in Vietnam is subject to increase.

This Circular comes into force from January 01, 2024.

At the same time, based on the provisions of Article 4 of Circular 66/2023/TT-BCA as follows:

7. Written residence information confirmation, coded CT07 and replacing Form CT07 issued together with Circular No. 56/2021/TT-BCA.
8. Written notification of residence procedure results/annulment of residence procedures, coded CT08 and replacing Form CT08 issued together with Circular No. 56/2021/TT-BCA.
9. Decision on annulment of residence procedures, coded CT09 and replacing Form CT09 issued together with Circular No. 56/2021/TT-BCA.
10. Residence information confirmation note, coded CT10 and replacing Form CT10 issued together with Circular No. 56/2021/TT-BCA.
11. Note of response to residence confirmation, coded CT10a.

Accordingly, the written residence information confirmation form - Form CT07 issued with Circular 66/2023/TT-BC will be applied in 2024, and replace Form CT07 issued with Circular 56/2021/TT-BCA.

Under the provisions of Article 7 of the Residence Law 2020:

Prohibited acts
1. Obstruct a citizen from exercising their right to freedom of residence.
2. Misuse information on permanent or temporary residence to restrict a citizen’s legitimate rights and interests.
3. Give, broker or receive a bribe for residence registration or management.
4. Fail to receive or postpone receipt of residence registration documents or information or other acts of harassment; fail to process or process a valid application for residence registration in a belated manner; annul permanent or temporary residence registration against regulations of law.
5. Collect, manage or use residence registration charges against regulations of law.
6. Impose a deadline, procedure, document or form against regulations of law or falsify information or a document on residence.
7. Deliberately issue or refuse to issue a document on residence against regulations of law.
8. Misuse the right to freedom of residence to violate state interests or legitimate rights and interests of an organization or individual.
9. Forge a document or data on residence; use a forged document or data on residence; provide inaccurate information or document on residence; make a false declaration or forge a document for permanent or temporary residence registration; buy, sell, hire, lease, borrow, lend, destroy, pawn or receive a document on residence as collateral.
10. Organize, incite, entice, persuade, aid and abet or force another person to commit a violation against regulations on residence.
11. Process an application for permanent or temporary residence registration when clearly knowing the applicant does not reside in the place in question.
12. Let another person register one’s place of residence as their permanent or temporary residence out of selfish interest or when they does not actually reside in such place.
13. Access, use, destroy, obstruct or disrupt operation of or change, delete, distribute or provide information in the residence database illegally.

Thus, the prohibited acts related to residence in Vietnam are specified above.
