Pursuant to Article 64 of the Law on Cultivation 2018 as follows:
Management and grant of codes of crop cultivation regions
1. The cultivation region code is an identification code of a crop production area used for monitoring and controlling production; controlling product quality; tracing the origin of crop products.
2. The State shall provide encouragement, incentive, and preferential policies for organizations and individuals applying for the grant of the crop cultivation zone’s code.
3. The Ministry of Agriculture and Rural Development shall develop the roadmap and provide instructions for the grant of codes of crop cultivation zones nationwide.
4. Provincial People’s Committees shall carry out the grant of the crop cultivation zone's code at respective provinces according to the roadmap and instructions of the Ministry of Agriculture and Rural Development.
Accordingly, the decentralization to manage and grant codes of crop cultivation regions in Vietnam is currently conducted under the roadmap and guidance of the Ministry of Agriculture and Rural Development. Meanwhile, the People's Committee of the province shall organize the grant of codes of crop cultivation regions according to the roadmap and guidance of the Ministry of Agriculture and Rural Development.
What are the duties of departments of agriculture and rural development in managing codes of crop cultivation regions for export in Vietnam?
On March 23, 2023, the Ministry of Agriculture and Rural Development issued Official Dispatch 1776/BNN-BVTV in 2023 on the grant and management of codes of crop cultivation regions and agricultural packaging facilities for export.
In order to contribute toward enhancing the efficiency of the management of codes of crop cultivation regions for export, the Ministry of Agriculture and Rural Development requests the Departments of agriculture and rural development to perform the following duties:
(1) The Department of Agriculture and Rural Development shall assign duties and direct the local specialized plant protection and quarantine agency (hereinafter collectively referred to as the local specialized agency):
- Perform and take responsibility for all establishment, physical inspection, completion of dossiers, grant of codes, and maintenance of technical conditions for issued codes of crop cultivation regions and agricultural packaging facilities.
All information on the area, yield, agreement of farmer households participating in the crop cultivation regions as well as other technical conditions must be fully checked and considered by local specialized agencies before sending reports to the Department of Plant Protection. Local professional agencies store and take responsibility for the accuracy and suitability of dossiers.
- In case of export, localities shall review the issued codes, compare them with the regulations of the importing country and compile a list of reports to the Department of Plant Protection to send to the importing country for approval or grant of codes. The importing country can conduct inspections in person or online before approving and issuing codes for these growing areas and packaging facilities.
- Immediately process applications by owners or representatives of crop cultivation regions and agricultural packaging facilities on the basis of compliance with regulations, transparency and responsibility. In case of unsatisfactory, there must be specific and clear instructions, avoiding people and enterprises traveling many times.
- Carry out periodic monitoring of crop cultivation regions and packaging facilities that have been issued codes in accordance with the instructions and regulations of the importing country, ensuring that these crop cultivation regions and packing facilities always maintain the condition of meeting the requirements of the importing country. The frequency of monitoring is at least once a year, for crop cultivation regions, pre-harvest monitoring is carried out. Report quarterly monitoring results to the Department of Plant Protection
- Revoke codes issued to crop cultivation regions and packaging facilities that do not meet regulations of the importing country or at the request of the importing country or detect repeated violations of regulations on phytosanitary and food safety or detect fraud, and disputes in the use of codes.
- Update full information on the national database on crop cultivation regions and export packaging facilities, guide people and enterprises to use field diary software, and packaging facility management software to fully update the information required by importing countries.
(2) Take initiative in planning, and establishing crop cultivation regions and packaging facilities eligible for grant of codes, promoting and strictly controlling links between people and exporters to ensure the interests of the parties.
(3) Allocate resources to perform well in the establishment and management of codes of crop cultivation regions and packaging facilities. Depending on the specific situation of the locality to actively organize the implementation, assign the specialized agency on plant protection and quarantine at the provincial level as the focal agency for implementation.
(4) Strengthen propaganda and training for people and enterprises in the area of regulations as well as related technical solutions to ensure compliance with regulations of importing countries.
(5) Take the initiative in inspecting and inspecting the grant and management of codes of crop cultivation regions in provinces and cities; immediately report to the Department of Plant Protection in case of detecting cases of violations or fraud on codes of crop cultivation regions and agricultural packaging facilities
(6) Coordinate with the Department of Plant Protection in resolving cases of non-compliance with the notification of the importing country; conduct periodic or irregular physical inspections (in person or online) at the request of the importing country.
What are the duties of the Department of Plant Protection in managing codes of crop cultivation regions for export in Vietnam?
In Official Dispatch 1776/BNN-BVTV of 2023, the Ministry of Agriculture and Rural Development requests the Department of Plant Protection to provide information on importing country's regulations on phytosanitary and food safety so that localities, organizations, and individuals wishing to export know and actively comply with these regulations.
At the same time, compile a list of codes of crop cultivation regions and agricultural packaging facilities at the request of localities, and negotiate for approval and grant of codes by the importing country.
