What are the purposes of the scheme for reducing and simplifying regulations related to business activities in the education and training sector in Vietnam?

On January 19, 2023, the Ministry of Education and Training issued Decision 301/QD-BGDDT 2023 on the scheme for reducing and simplifying regulations related to business activities in the education and training sector of Vietnam (hereinafter collectively referred to as the "Scheme").

Accordingly, in subsection 1, Section I of the Scheme issued together with Decision 301/QD-BGDDT in 2023, the purposes of the scheme are determined as follows:

- Ensure timely, uniform, scientific, and effective implementation of the contents identified in the Government's Resolution 68/NQ-CP in 2020 on the program of reducing and simplifying regulations related to business activities in the period of 2020 - 2025.

- Strictly control the promulgation of legal documents with regulations related to business activities on the basis of legal provisions, especially administrative documents, circulars issued by the Minister of Education and Training, decisions of the Prime Minister, and decrees of the Government;

- Prevent the arising of unnecessary, unreasonable, illegal regulations and the causing of difficulties for business activities of enterprises and people.

What are the general requirements when implementing the scheme for reducing and simplifying regulations related to business activities in Vietnam?

The general requirements when implementing the scheme for reducing and simplifying regulations related to business activities in Vietnam are defined in Subsection 2, Section I of the Scheme issued together with Decision 301/QD-BGDDT in 2023 as follows:

- Specify the working contents, deadlines, expected products, and responsibilities of units under the Ministry in organizing the execution of Resolution 68/NQ-CP in 2023.

- The results of the reduction and simplification must quantify the benefits brought to enterprises, people, and society without adverse effects on the legitimate activities, rights, and interests of enterprises and people; ensure the objectives of state management without legal gaps in legal regulations.

- When promulgating legal documents related to business activities, it is necessary to ensure the integration of many contents in one document to minimize the number of detailed legal documents, ensure consistency, and facilitate the execution and compliance with the law.

What are the contents of the scheme for reducing and simplifying regulations related to business activities in the education and training sector of Vietnam?

Pursuant to Section II of the Scheme promulgated together with Decision 301/QD-BGDDT in 2023, the contents of the scheme for reducing and simplifying regulations related to business activities in the education and training sector of Vietnam include:

- Conduct statistics, review, calculation of compliance costs, reduction and simplification of unreasonable regulations, which are barriers, causing difficulties for business activities in legal documents that the Ministry of Education and Training is assigned to develop and promulgate according to its competence or submit to competent authorities for promulgation; which focuses on reviewing, reducing and simplifying regulations related to the reporting regime.

- Develop plans to reduce and simplify regulations related to business activities and send comments to relevant ministries and agencies before submitting them to the Prime Minister for approval.

- Organize consultations on regulations that are no longer suitable, causing difficulties for business activities and plans for reduction and simplification; propose the competent authority to amend, supplement, abolish or replace the regulations.

- Formulate and submit to the Government for promulgation an execution document of the scheme to reduce and simplify (amend, supplement, replace or abolish) regulations related to business activities within the scope of management functions of the Ministry immediately after the plans for the reduction and simplification are approved by the Prime Minister.

- Strictly control regulations related to business activities through assessing the impacts of regulations incurring compliance costs for enterprise and people, appraising, and verifying during developing and promulgating legal documents.

- Conduct statistics, update data and, calculate compliance costs for regulations related to business activities under the ministry's management into database software and business regulation consultation portal under the guidance of the Government Office.

Thus, the scheme for reducing and simplifying regulations related to business activities in the education and training sector of Vietnam has 06 main contents mentioned above.

Accordingly, heads of units under the Ministry are responsible for directing and organizing the performance of assigned tasks in the Appendix attached to this Scheme to be in accordance with the schedule and ensure efficiency and quality.

The Government Office shall monitor and urge the implementation of the Scheme, periodically report and recommend necessary measures to ensure that this Scheme is implemented effectively and on schedule to the Minister.
