Vietnam: What is the required age as Team Leader? When the primary school teacher expires as Team Leader but wants to continue doing so, who must notify?

I have looked at Circular 27 but there isn't any point specifying the age of the Team Leader because most of the views of the leaders of the educational institution say that the General Manager of the Older Team should not be the General Manager. I want to ask for Vietnamese regulations on this information? Mr. Son (Hai Duong).

What is the required age of an elementary school teacher to be the prescribed Team Superintendent in Vietnam?

In Article 2 of Circular 27/2017/TT-BGDDT, there are regulations on the required age of primary school teachers to be in charge of the team as follows:

Standards of teachers as Team Superintendents
1. Teachers selected to be appointed as Team Leaders must meet the following criteria:
a) Meet the criteria for professional titles of teachers according to the professional titles held by teachers (standards for primary school teachers specified in Joint Circular No. 21/2015/TTLT-BGDDT-BNV dated September 16, 2015 stipulating codes and standards of professional titles of public primary school teachers; standards for lower secondary school teachers specified in Joint Circular No. 22/2015/TTLT-BGDDT-BNV dated September 16, 2015 stipulating codes and standards for professional titles of public lower secondary school teachers).
b) Have been trained in team work in the same major of teaching or fostering professional skills in team work.
c/ Having the capacity to coordinate with organizations inside and outside the school to organize team activities and children's movements.
2. Prioritize the selection of teachers capable of music, fine arts, physical education, presentations, events and communication to help the school organize well the activities of the team and children's movement.

According to the above regulations, there is no age standard for primary school teachers to be Team Superintendents. As long as the above conditions are met, it is okay.

According to Clause 2, Article 5 of Circular 27/2017/TT-BGDDT, there are regulations on the duration of primary teachers to be in charge of the team as follows:

The duration of the teacher's appointment as the General Manager of the Team
1. The term of appointment of the teacher as the General Manager of the Team is 05 years. At the end of the above period, the school is responsible for arranging teachers to return to teaching in accordance with the trained major.
2. In case the teacher expires his/her term of appointment but is still qualified and wishes to continue to be the General Manager of the Team, the principal shall agree with the School Council to consider and decide according to the provisions of Clause 2, Article 4 of this Circular.
3. In case the teacher who has not expired his/her appointment period is not the General Manager of the Team, the principal shall issue a decision to dismiss the teacher as the General Manager of the Team, and at the same time consider, select and appoint another teacher to replace him as prescribed in Clause 2, Article 4 of this Circular.

Accordingly, in case the teacher expires his/her term of appointment but is still qualified and wishes to continue to be the General Manager of the Team, the principal shall agree with the School Council to consider and decide as prescribed in Clause 2, Article 4 of Circular 27/2017/TT-BGDDT.

How is the elementary school teacher who serves as Team General subject to the rights duties in Vietnam?

Regarding the duties and powers of primary school teachers as general managers of the team, the provisions of Article 3 of Circular 27/ 2017/TT-BGDDT are as follows:

- Perform the duties and powers of teachers at each level of education as prescribed in the current school charter.

- Advising the principal on professional issues, team work and children's movements within the school.

- Plan, organize and manage activities programs for team members and students in the school according to the plan of the Education sector, the team work program and the children's movement of the Team Council at all levels.

- Building a system of organizing the team in the school according to the principles of organization and operation of the Ho Chi Minh Youth Pioneer Team; fostering the team in charge of the detachment, the command board of the Team at all levels.

- Coordinate with relevant organizations and individuals to organize team activities and children's movements, educational activities in schools.

- Study, train and attend professional training classes, pedagogical skills, team work and children's movement organized by the Education sector, Team Council at all levels to improve professional skills.

- Be guaranteed conditions for the implementation of team activities and children's movements, educational activities in accordance with the actual conditions of the school and locality.
