What does the application for acceptance testing, transfer and receipt of assets eligible for concentrated procurement in Vietnam include?
Pursuant to the provisions of Article 80 of Decree 151/2017/ND-CP as follows:
Transfer and receipt of assets
1. In case of concentrated procurement under the framework agreement, the transfer and receipt of assets shall be effected between the contractor providing assets and the agency, organization or unit directly using the assets under the signed contract.
2. In case of concentrated procurement under contracts, based on the signed procurement contract, the concentrated purchasing unit shall notify the plan and time of transferring assets to the agencies, organizations or units directly using assets at least 15 days before the date of transfer.
The transfer and receipt of assets is carried out by three parties (the contractors providing assets, the concentrated purchasing unit and the agency, organization or unit directly using the asset). Locations for transferring and receiving assets must be convenient for agencies, units and organizations to use assets and save costs when transferring and receiving assets.
3. The transfer and receipt of assets must be made in a record of acceptance testing, transfer and receipt of assets according to the provisions of Form No. 06/TSC-MSTT issued together with this Decree, enclosed with the following documents:
a) Oiginal procurement contract;b
b) Original invoices
c) Original warranties;
d) Original deliverables and manuals;
dd) Other relevant documents (if any).
4. Agencies, organizations and units that directly use assets are responsible for receiving, accounting, managing and using the equipped assets in accordance with the law on accounting and the Law on Management and Use of public property and this Decree.
Thus, the application for acceptance testing, transfer and receipt of assets eligible for concentrated procurement in Vietnam includes:
- Record form of acceptance testing, transfer and receipt of assets
- Original procurement contract;
- Original invoices
- Original warranties;
- Original deliverables and manuals;
- Other relevant documents (if any).
Who is responsible for liquidating procurement contracts in Vietnam?
According to Article 81 of Decree 151/2017/ND-CP, the regulations on responsibility for liquidation of procurement contracts are as follows:
Finalization and liquidation of procurement contracts
1. The agency, organization or unit that signs the procurement contract shall be responsible for liquidating the asset procurement contract with the selected contractor.
2. Finalization of asset procurement expenses:
a) The concentrated purchasing unit is responsible for finalizing with the program/project management agency in case of concentrated procurement under contracts in which the program/project management agency transfers expenses to the program/project management agency to pay to contractors;
b) The agency, organization or unit directly using assets shall finalize expenses of asset procurement in cases that are not specified at Point a of this Clause.
3. The finalization and liquidation of procurement contracts shall comply with the law and the procurement contracts signed with the selected contractor.
Accordingly, the responsibility for liquidating procurement contracts with the selected contractor will belong to the agency, organization or unit that signs the procurement contracts.
