What are the principles for determining job positions of civil servants in charge of professional knowledge of construction in Vietnam?

Pursuant to the provisions of Clause 1 Article 3 of Circular 11/2023/TT-BXD as follows:

Principles and grounds for determining job positions of civil servants in charge of professional knowledge of construction
1. Principles for determining job positions of civil servants in charge of professional knowledge on construction shall comply with the provisions of Article 3 of the Government's Decree No. 62/2020/ND-CP dated June 01, 6, 2020 on job positions and payroll of civil servants.

Under Article 3 of Decree 62/2020/ND-CP as follows:

Principles of determining job positions and managing the payroll of civil servants
1. Comply with the Party's regulations and the law on job positions, management and use of civil servants' payroll.
2. Conform to the functions, tasks, powers and organizational structure of the agency or organization.
3. Ensure consistency and synchronization between the determination of job positions, the structure of civil servant ranks, and employment and management of civil servants' payroll.
4. Ensure scientific, objective, public, transparent, democratic and practical conformity.
5. Associate downsizing with the restructuring and improvement of the quality of civil servants in agencies and organizations.

Thus, based on the above regulations, the principles for determining job positions of civil servants in charge of professional knowledge on construction in Vietnam are:

- Comply with the Party's regulations and the law on job positions, management and use of civil servants' payroll.

What are the cases of adjustment to job positions of civil servants in charge of professional knowledge of construction in Vietnam?

According to Article 9 of Decree 62/2020/ND-CP stipulating the adjustment to job positions as follows:

Adjustment to job positions
1. The adjustment to job positions in agencies or organizations shall be made in the following cases:
a/ The agency or organization has changed one of the grounds specified in Clause 1, Article 4 of this Decree;
b/ The agency or organization is reorganized under a decision of competent authority.
2. The procedures and application for adjustment to job positions in agencies and organizations shall comply with the provisions of Articles 7 and 8 of this Decree together with documents of competent authorities related to the adjustment to job positions.

Thus, based on the above regulations, the cases of adjustment to job positions of civil servants in charge of professional knowledge on construction in Vietnam are:

- The agency or organization has changed one of the following grounds:

+ Functions, tasks, powers and organizational structure of the agency or organization;

+ The complexity, nature, characteristics and scale of operation; scope and subjects of service; professional management processes in accordance with specialized laws.

- The agency or organization is reorganized under a decision of competent authority.

Circular 11/2023/TT-BXD will take effect from December 5, 2023.
