What is the latest electronic birth certificate form in Vietnam?

Pursuant to Circular 01/2022/TT-BTP guiding Decree 87/2020/ND-CP on electronic civil status database and online civil registration as follows:

The latest electronic birth certificate form in Vietnam is currently made according to Annex 1 issued together with Circular 01/2022/TT-BTP.

Accordingly, the QR code on the electronic birth certificate is the Internet address that leads to the data and image format of the corresponding birth certificate in the electronic civil status database, which is valid for providing information about the accuracy, validity, and details of the birth certificate in the electronic civil status database.

In 2023, what are the procedures for issuing an electronic birth certificate in Vietnam?

Pursuant to the provisions of Article 12 of Decree 87/2020/ND-CP, persons can apply for birth registration online on the portal of the National Public Service Portal. However, because birth registration requires the applicant to be present at the civil status registration authority to sign the Civil Status Book. Currently, the applicants can receive only physical birth certificates (not an electronic version) at the civil status registration authority.

Pursuant to Subsection 1 Section C Part II of the Appendix promulgated together with Decision 2228/QD-BTP in 2022, the procedures for issuing an electronic birth certificate in Vietnam on the National Public Service Portal are carried out as follows:

Step 1:

The applicant access the National Public Service Portal, and the Provincial Public Service Portal to register an account, and authenticate users according to instructions.

Step 2:

After successfully logging into the account, the applicant provides the necessary information in an interactive electronic form, attaching photocopies or electronic copies from documents and documents

Step 3:

The applicant pays fees and charges.

Step 4:

After completing the submission of the application, the applicant is issued 01 administrative procedure file number.

(This code is used for the purpose of monitoring, looking up the progress of processing documents or completing documents at the request of civil status authorities)

Step 5:

The civil status registration officer checks the completeness and suitability of the application during the working day

Step 6:

- In case the application is incomplete or inappropriate: The applicant supplements, and completes the necessary documents

- In case the application is complete and in accordance with the law: The applicant receives an appointment letter to return results via email or an appointment message to return results via mobile phone

- In case it is necessary to check, verify and clarify or due to other reasons, it is not possible to return the civil status registration results on time as scheduled: The applicant receives an apology form via email or mobile phone message

Step 7:

The applicant receives the result of civil status documents at the civil status registration authority.

When receiving results at the civil status registration authority, the applicant must submit and present the papers and documents that are part of the application for birth registration in accordance with the Law on civil status.

Is it possible to use electronic birth certificates to replace physical birth certificates in Vietnam?

Pursuant to the provisions of Clause 2 Article 9 of Circular 01/2022/TT-BTP on the legal validity of electronic copies of civil status documents as follows:

2. The legal validity of electronic civil status documents shall comply with the provisions of Clause 6 Article 12 of Decree No. 87/2020/ND-CP and the following instructions:
a) Electronic civil status documents are valid for use as physical civil status documents in transactions and administrative procedures carried out online; valid to replace physical civil status documents when carrying out procedures for civil status registration directly at the civil status registration authority.
b) The QR code on the electronic civil status documents is the Internet address that leads to the data and image format of the corresponding civil status document in the electronic civil status database, which is valid for providing information about the accuracy, validity and details of civil status documents in the electronic civil status database.
c) Individuals, agencies and organizations, upon receiving electronic civil status documents submitted and presented by applicants for civil status registration, may check the accuracy, expiry date and updated information of electronic civil status documents through the QR code on the electronic documents.

Thus, according to the above regulations, it is possible to use electronic birth certificates to replace physical birth certificates in Vietnam when carrying out the procedures for civil status registration directly at the civil status registration authority.
