In what cases will communist party members in Vietnam be removed from the list of communist party members?

Pursuant to Clause 8.1, Article 8 of Regulation 24-QD/TW in 2021 as follows:

Remove communist party members' names and settle complaints against removal of communist party members' names.
8.1. Remove communist party members' names.
The branch shall consider and request the competent committee to decide on removing communist party members' names from the list of communist party members in the following cases: communist party members fail to participate in party activities or to pay party fees for three months of the year without valid reasons; communist party members voluntarily return communist party membership cards or self-destruct communist party membership cards; communist party members who have reduced their will to strive, fail to perform their duties as communist party members, or have been educated by the ministries without progress after12 months of striving; communist party membership for consecutive two years violates communist party member status; communist party members fail to meet the political standards prescribed by the Politburo.
8.2. Settle complaints against removal of communist party members' names.
8.2.1. Within 30 working days from the date of receipt of decisions on removing their names, communist party members have the right to make complaints to superiors or the Secretariat of the Party Central Committee.
8.2.2. The organizing body of the committee shall advise the committee on settling complaints. The time limit for settling complaints is prescribed as follows: within 90 working days for provinces, districts, and equivalents; within 180 working days for the central level from the date of receipt of the complaints.
8.2.3. Failure to settle complaints in the following cases: beyond 30 working days from the date the communist party member receives the decision on removing his or her name; have been considered and concluded by the highest authority; authorize an individual or collective to make complaints; or make complaints when there is no decision on removing communist party member’s name.
8.2.4. The settlement of complaints against removal of communist party members' names abroad has its own regulations.

Pursuant to subsection 11.1 of Section 11 of Instruction 01-HD/TW of 2021 as follows:

Remove communist party members’ names from the list of communist party members and communist party members applying for leaving Party
11.1. Removal of communist party members' names from the list of communist party members
a) Communist party members make a self-review and review before the branch. If the branch committee requests a third time, but the communist party member fails to complete the review or does not attend the review meeting, the branch will still consider and handle that communist party member.
In case a communist party member deliberately fails to complete the review at the request of the branch, the branch shall immediately carry out the procedures for removal of the communist party member's name.
b) Branches, party committees (if any), internal party committees, and competent authorities shall consider to remove communist party members' names and carry out consideration procedures according to the instructions in Point 4.6, Section 4 of this guideline.
c) Settling complaints against the removal of communist party members' names:
Comply with the regulations of the Central Committee.

Thus, according to the above regulations, communist party members in the following five cases will be removed from the list of communist party members:

What are the procedures for removal of reserve communist party members’ names who commit violations against the communist party member status in Vietnam?

Pursuant to subsection 4.6, Section 4, Guideline 01-HD/TW in 2021 as follows:

Step 1: If two-thirds of official communist party members or more agree to remove reserve communist party members’ names, Party branches shall issue resolutions and report them to the superior party committees.

Step 2: If two-thirds of communist party members or more vote to agree to remove reserve communist party members’ names, The internal party committee shall consider issuing resolutions and report them to the competent party committee.

Step 3: The standing committee of the party committee has the authority to admit communist party members; if more than half of members agree to remove reserve communist party members’ names, the committee will issue decisions to remove their names.

Step 4: The internal party committee is authorized to decide on admitting communist party members and issuing decisions on removing reserve communist party members’ names with the consent of at least two-thirds of official communist party members.
